On January 18, 2019, two plaintiffs, represented by Disability Rights New York (the state’s protection and advocacy system) who are individuals with mobility impairments and who use mobility aids sought declaratory and injunctive relief against the City of Troy, for its failure to provide accessible sidewalks, curb cuts, pedestrian crossings, and roads under Title II of the Americans with Disabilities, 42 U.S.C. § 12131 et seq., and Section 504, 29 U.S.C. § 794. 2. Plaintiffs asserted that they and others are not able to safely navigate around the city due to improper construction and maintenance. The case was filed in the United States District Court, Northern District of New York.  The case was assigned to Magistrate Judge Therese Wiley Dancks and Judge Gary L. Sharpe. The case proceeded to mediation.  The plaintiffs filed a motion for summary judgment on December 15, 2021 and the city filed a motion to dismiss on December 20, 2022.  On October 27, 2022 the court denied the plaintiff’s motion and granted the city’s motion to dismiss. It granted dismissal on the ground that the plaintiffs lacked standing to pursue any remedy spanning beyond the two sites of their allege injuries or to pursue retrospective declaratory relief with respect to those sites, and that the request for relief as to the sites of the injuries had been mooted because the City had remedied the issue.  On November 25, 2022, the plaintiffs appealed the decision.  The case, as of December 2023, is scheduled to be heard in March 2024.

TEXT ORDER: Court has reviewed letter briefs (Dkt. Nos. 38 and 39 ) regarding dispute over scope of Rule 30(b)(6) deposition of defendant City of Troy. Upon careful consideration of the parties' arguments and relevant case law, and in view of the claims asserted, the Court agrees with plaintiffs who are qualified individuals under the ADA and defendant is subject to the ADA. The Court finds the defendant's sidewalk program is relevant to plaintiffs' claims regarding plaintiffs' rights to use defendant's sidewalk program and should not be limited to the locations to which plaintiffs testified they routinely travel. The Court finds the narrowed scope of Topics 1 and 2, as set forth by plaintiffs at Dkt. No. 38 at 2, regarding information pertaining to the physical condition and accessibility of the sidewalks, curb cuts, and crosswalks in Troy, defined as the core downtown areas from Front Street to Sixth Ave and Federal Street to Ferry Street, from January 1, 2015 to present, is relevant, particularly described, proportional to the needs of the case, and not unduly burdensome.
