This case is about a Protection and Advocacy agency’s request to obtain contact information for the guardians of public school students who were on a waitlist for special education services. Disability Rights Pennsylvania (DRP) requested this information from the School District of Philadelphia citing both the Developmental Disabilities Assistance and Bill of Rights Act (42 U.S.C. §§ 15041 et seq.) and Protection and Advocacy for Individuals with Mental Illness Act (42 U.S.C. § 10801 et seq.). The school district refused to provide the contact information and on October 31, 2017, DRP, representing itself, filed suit in the U.S. District Court for the Eastern District of Pennsylvania. The case was assigned to District Judge Nitza Quinones Alejandro. Bringing suit under 42. U.S.C. § 1983, DRP asked the court for declaratory and injunctive relief, as well as attorneys’ fees.
Soon after the case was filed, both parties filed motions asking the court to decide the ultimate legal question of whether the district was required to turn over the information. DRP filed a motion for summary judgment on March 1, 2018 while the School District filed a motion for judgment on the pleadings on March 8, 2018. On March 28, 2019, Judge Alejandro issued an opinion in favor of DRP but technically denying both the motions of both parties. She held that DRP was not required to show probable cause to suspect abuse or neglect or to prove that it had received a complaint in order to obtain the contact information it requested and ordered the district to turn over the information.
After Judge Alejandro’s ruling, DRP filed a motion for fees and costs on April 11, 2019, which they withdrew on April 25. The School District filed a notice of appeal on April 26, 2019. However, both parties dropped eventually dropped their respective requests. The case was dismissed without cost to either party on October 24, 2019.
