This is a case challenging a raid against approximately 200 black incarcerated people at the Correctional Training Facility, as well as the policies and practices by which incarcerated persons in the California Department of Corrections and Rehabilitation (CDCR) are “validated” as suspects, associates, or members of Security Threat Groups.   

On December 13, 2021, two incarcerated individuals filed this putative class-action lawsuit on behalf of themselves and similarly situated Black incarcerated people who were subjected to a raid on July 20, 2020, at the Correctional Training Facility, and a subclass who received a source item (alleged evidence of Security Threat Group involvement) or were Security Threat Group validated as a result of or after the raid. The lawsuit was filed in the U.S. District Court for the Northern District of California. The plaintiffs sued the CDCR and various individual employees, bringing claims under Title VI of the Civil Rights Act, 42 U.S.C. Section 1983, and state law alleging race discrimination, violations of equal protection and free speech, unreasonable search and seizure, battery, negligence, and retaliation.  The claims stem from the July 20, 2020 raid, during which they were allegedly beaten, handcuffed, and questioned about their involvement in Black liberation movements, and after which more than 50 individuals were validated as affiliated with Security Threat Groups.  

Represented by private counsel, the plaintiffs sought a declaratory judgment, injunctive relief, compensatory and punitive damages, and attorneys fees and costs. The case was assigned to Magistrate Judge Laurel Beeler and then reassigned to Judge Jon Tigar.

As of May 26, 2022, this case is ongoing.
