This class action, filed on June 4, 2010 in the U.S. District Court for the Northern District of Illinois, challenged a Palos Hills Police Department policy under which every person taken into custody was subjected to video monitoring and recording while using the toilet. Plaintiff, along with a class of others who had been subjected to the policy after arrest, sued the Village of Palos Hills and its police chief, Paul J. Madigan, pursuant to 42 U.S.C. § 1983 for Fourth Amendment, Fourteenth Amendment, and Illinois privacy law violations. The case was assigned to Judge Amy J. St. Eve. 

In November 2011, the case was referred to Magistrate Judge Jeffrey T. Gilbert to conduct a settlement negotiations. The negotiations lasted about eight months. During this time, the plaintiffs voluntarily dismissed the Police Chief without prejudice. On August 2, Judge St. Eve preliminarily approved the settlement, certified the settlement class, and set deadlines to effectuate the settlement. The settlement class included “all persons who, between June 4, 2008 and July 30, 2012, were subjected to Defendant’s policy of video monitoring and recording all areas of lockup, including the toilet area inside the cells at the Palos Hills police station.”

On October 15, 2012, the court held a Fairness Hearing and found the settlement terms fair, reasonable, and adequate. The settlement required the Village of Palos Hills to change their policy of video monitoring and recording of all persons taken into custody to incorporate a pixelated camera view of the area of the cells that included the toilet. It also required that a claims procedure be established pursuant to which all class members who timely filed a valid proof of claim by the submission deadline would be entitled to receive a pro rata share of the settlement fund, not to exceed $300. The terms of the settlement also provided that Palos Hills would pay an incentive award to the class representative of $5,000. The court retained jurisdiction for the purpose of enforcing the terms of the settlement agreement, but otherwise dismissed the case with prejudice.
