This is a class action lawsuit about equitable athletic opportunities for female students. On February 23, 2010, a group of female student-athletes filed this lawsuit in the U.S. District Court for the District of Delaware. The plaintiffs sued Delaware State University (DSU) under Title IX. Represented by the Women's Law Project and a commercial business law firm, the plaintiffs sought class action certification, declaratory judgment, a temporary restraining order, a preliminary injunction, a final injunction, and costs and expenses. The plaintiffs alleged that DSU underfunded opportunities for female students to participate in athletic opportunities as compare to the percentage of female students enrolled at the school. As one example of this failure to provide equitable opportunities, the plaintiffs highlighted DSU's decision to eliminate the women's equestrian team.

The plaintiffs claimed that Delaware State University failed to meet any of the criteria for compliance with Title IX's equal participation requirement, Plaintiffs also claimed that defendant's failure to provide equivalent recruiting resources to the women's athletic programs has deprived female students of equal athletic opportunities, and that defendant discriminated against women on the basis of sex in intercollegiate athletics in violation of Title IX. 

Although the plaintiffs initially sought a preliminary injunction to restore the equestrian team, they eventually reached an agreement to accomplish this result. On April 7, 2010, Judge Leonard P. Stark approved a consent order requiring DSU to provide full and equal funding to the women's equestrian team for the 2010-11 school year.

On June 10, 2010, plaintiffs filed an amended complaint to reflect the withdrawal and addition of certain named plaintiffs. Two days later, on July 12, 2010, Judge Leonard P. Stark certified as a class all present, prospective, and future Delaware State University female students who participate, seek to participate, or have been deterred or prevented from participating in or obtaining the benefits of intercollegiate athletics sponsored by Delaware State University. Foltz v. Delaware State University, 269 F.R.D. 419 (D.Del., 2010). 

After additional discovery and proceedings, Judge Leonard P. Stark signed a consent decree on December 20, 2010. Among other requirements, the consent decree ordered Delaware State University to comply with Prong 1 of Title IX's participation test, maintain the women's equestrian team until either certain benchmarks had been met, increase the amount of funds allocated to women's varsity athletic teams until the allocation of recruitment funds allocated to men's and women's varsity athletic teams are equal, require trainings on Title IX for members of the Athletic Department, coaches, and athletes, and pay plaintiffs' reasonable attorney's fees and costs. The consent decree was scheduled to terminate on either June 30, 2015 or on June 30 of the academic year after DSU achieved compliance with the consent decree.

In December 2010, plaintiffs received fees and costs. In 2014, plaintiffs requested reasonable attorney's fees for their efforts related to monitoring the enforcement of the consent decree. Delaware State University opposed the request, arguing that specific monitoring activities undertaken were not authorized by or within the scope of the consent decree, and that consequently, plaintiff's monitoring efforts were unreasonable. Defendant also argues that the fees requested by plaintiffs were unreasonable, and should be reduced. On September 30, 2014, Judge Leonard P. Stark concluded that plaintiffs' requested fees were reasonable, and granted plaintiffs' request for attorney's fees and costs related to enforcement of the consent decree. Foltz v. Delaware State University, 70 F.Supp.3d 699 (D.Del., 2014). 

On April 7, 2016, the plaintiffs filed another motion for attorney’s fees related to enforcement of the consent decree, and the motion was granted three months later.

Six years later, on June 24, 2022, the parties filed a joint motion for preliminary approval of a revised consent decree. The case was reassigned to Magistrate Judge Mary Pat Thynge, who granted the motion on August 3, 2022. The following month, the case was also reassigned to Judge Gregory B. Williams. 

The court approved the revised Consent Decree on September 19, 2022. The revised consent decree required DSU to increase the percentage of female varsity athletes from 55% to 60% by adding two teams before 2027, and would extend the consent decree by two years if this was not achieved by 2027. The revised consent decree also laid out other obligations, including reporting information to the plaintiffs’ counsel, conducting sports investigations periodically, and creating a Gender Equity in Athletics Committee.

As of November 20, 2023, the case is ongoing, with the revised consent decree in effect.
