A person twice convicted under New Hampshire's criminal defamation law, N.H. Rev. Stat. § 644:11, sued New Hampshire's attorney general to challenge that law. The suit was filed on December 18, 2018, in the United States District Court for the District of New Hampshire and was assigned to Judge Joseph N. Laplante. The plaintiff asserted that the criminal defamation law violated the First Amendment because it was excessively vague. The plaintiff sought declaratory relief, a permanent injunction prohibiting New Hampshire from enforcing § 644:11, attorneys' fees, and costs. The attorney general moved to dismiss claiming that the plaintiff lacked standing and that the plaintiff failed to state a First Amendment vagueness claim because § 644:11 included a scienter requirement. The court denied the motion in a published opinion on October 19, 2019, holding that the plaintiff had standing and sufficiently stated a First Amendment vagueness claim. 425 F.Supp.3d 64 (D.N.H. 2019).

The plaintiff than amended his complaint on April 13, 2020, to add additional constitutional claims. The plaintiff relocated his vagueness challenge as falling under the Fourteenth Amendment Due Process Clause. Meanwhile, the plaintiff asserted that the New Hampshire law violated the First Amendment because it was overbroad in criminalizing speech criticizing public officials. The plaintiff's First Amendment claim challenged the law at issue both facially and as-applied to his criticism of public officials. The defendant again moved to dismiss, claiming that the plaintiff lacked standing and that he failed to state a First Amendment vagueness claim. The defendant cited new authority to support its second asserted basis for dismissal. The court granted the motion on January 12, 2021. The court held that the plaintiff's First Amendment claim was precluded by the Supreme Court's binding precedent in Garrison v. Louisiana, 379 US 64 (1964), which upheld a criminal defamation statute. The court also held that § 644:11 was not unconstitutionally vague because it sufficiently specified the standard of prohibited conduct (namely, it prohibited defamatory speech that the defendant subjectively believed was false). The plaintiff appealed to the United States Court of Appeals for the First Circuit. The First Circuit heard oral argument on October 28, 2021, and the appeal is currently pending in that court.
