This case involved a series of strip searches of female inmates at the Jackson County Jail on July 16, 2008. On June 1, 2010, two ex-inmates of the jail filed this lawsuit on behalf of themselves and others similarly situated in the U.S. District Court for the Southern District of Indiana. The plaintiffs sued Jackson County; the Jackson County Sheriff’s Department; the Sheriff, in his official and individual capacities; and the Jail Commander, in his official and individual capacities. Represented by Haskin & LaRue, LLP, the plaintiffs sought a declaratory judgment, compensatory damages, and punitive damages. They claimed that the strip searches to which they were subjected—and which were performed in view of male employees and male and female inmates—were unjustified and violated their Fourth, Eighth, and Fourteenth Amendment rights. The plaintiffs also sought to certify a class consisting of all female inmates who were subjected to strip searches on the above date. The case was referred to Judge Richard L. Young and was later assigned to Magistrate Judge Debra McVicker Lynch.

On October 29, 2010, the plaintiffs filed a motion for class certification. The proposed class included: “All female inmates strip searched at the Jackson County Jail on July 16, 2008." After briefing by both sides, the court granted the motion on July 27, 2011. First, the court addressed the certification factors in FRCP 23(a). The court explained that, although the proposed class of approximately thirty-two people was on the smaller side, the insignificant damages at issue in the individual claims, the embarrassing nature of the allegations, and judicial economy justified a finding of numerosity. Finding the remaining requirements – typicality, commonality, and adequacy – met for the class seeking injunctive and declaratory relief, the court certified the (b)(2) class.  In certifying the damages class, the court also found that the predominance and superiority requirements of 23(b)(3) were satisfied. 

On July 10, 2012, the parties filed a motion for preliminary approval of their stipulated settlement. The proposed settlement awarded $214.03 to each class member. As class representatives, Morton and Trapp would each receive an additional $200, and defendants would pay $4,751.04 for attorneys fees. The settlement totalled $12,000. The stipulation also specified that the settlement did not constitute an admission of liability by the defendants, and that it released the defendants from any claims that were or could have been alleged in the complaint relating exclusively to the strip searches described above. In the same filing, the parties moved the court to schedule a fairness hearing for final consideration of the proposed settlement. 

On July 16, the court preliminarily approved the stipulation of settlement. After the fairness hearing on October 1, 2012, the court ordered the final approval of the proposed settlement on October 16. The court found that the settlement was in the best interest of the class members, the attorneys fees of class counsel were fair and reasonable, that adequate and timely notice had been provided to all class members prior to the fairness hearing, and that none of the class members had objected to the proposed settlement. 

The case is closed.
