This is a case about a pattern or practice of holding incarcerated people beyond their court-ordered release in the State of Maryland. The plaintiff in this case is an individual who was incarcerated at the Baltimore Central Booking and Intake Center for an additional 21 hours and 57 minutes after a court ordered his release from custody. The plaintiff sought to represent a class of all those similarly situated and brought this case in the Maryland Circuit Court for Baltimore City on March 14, 2022, against the State of Maryland and its Department of Public Safety and Correctional Services. It was removed to the United States District Court for the District of Maryland on April 13, 2022. 

The plaintiff claimed that the average detainee in the Baltimore Central Booking and Intake Center was held for more than 14 hours after a court ordered their release. The plaintiff further alleged that Black people were disproportionately the victims of this pattern of overdetention. The plaintiff asserted that this overdetention violated the Fourth, Eighth, and Fourteenth Amendments, that there was no justification or probable cause to further detain the plaintiff or members of the putative class, and that the overdetention violated Maryland’s state constitutional analogues. Finally, the plaintiff brought a common law claim for false imprisonment. As such, the plaintiff sought injunctive relief and monetary damages on a class-wide basis.
