This is a case about the Central American Minors (CAM) program and the Biden administration’s policy of allowing certain undocumented individuals from El Salvador, Guatemala, or Honduras with pending asylum applications to petition to bring their minor children into the United States. On January 28, 2022, the states of Texas, Alaska, Arkansas, Florida, Indiana, Missouri, Montana, and Oklahoma filed this lawsuit in the Northern District of Texas. The states sued the United States government under the Administrative Procedure Act (“APA”), Immigration and Nationality Act (“INA”), and the United States Constitution. Seeking injunctive and declaratory relief, the states claimed that the federal government’s actions were arbitrary and capricious, violated the APA’s notice and comment rule making regime, and violated the INA and, by extension, the take care clause of the Constitution. The case was assigned to Chief Judge Barbara M.G. Lynn.

After filing this lawsuit, the states filed an additional document indicating that this case was related to Texas v. Biden, 2:21-cv-00067, proceeding before Judge Matthew J. Kacsmaryk also in the Northern District of Texas. On February 2, 2022, Chief Judge Lynn issued an order indicating that the court would evaluate whether this case should be transferred as a result. In late March, the court determined that the cases were not sufficiently related. Shortly thereafter, the case was transferred from the Amarillo division to Chief Judge Lynn’s division in Dallas. 

In mid-March 2022, the states filed an amended complaint with seven additional states—Alabama, Arizona, Idaho, Kentucky, Louisiana, South Carolina, and Utah—joining as plaintiffs. On May 26, the court granted the motion of two parents–who were applicants of CAM–to intervene in the case as defendants.

Parties then entered a period of jurisdictional discovery beginning in August 2022, and the Court stayed all other proceedings in the court while jurisdictional discovery was ongoing. During this period, the state of Arizona voluntarily dismissed its complaint on February 28, 2023. The remaining parties continued to file status reports regarding jurisdictional discovery through July 2023. Then, on July, 20, 2023, the Court ordered the parties to present a schedule for their plans to proceed with the case, and order Plaintiffs to inform the Court of the likelihood of their pursuing the case beyond its current preliminary stage.

On August 29, 2023, with leave from the court, Plaintiffs filed a supplemental complaint. Plaintiffs alleged that certain enhancements expanding eligibility to the Biden administration’s CAM program, adopted on April 11, 2023, also violated the APA, INA, and the United States Constitution, and caused irreparable harm to Plaintiffs. The Court granted the motion of four parents–who were prospective applicants of CAM–to intervene in the case as additional defendants on September 6, 2023.

On October 16, 2023, defendants filed a motion to dismiss for lack of jurisdiction and failure to state a claim, and intervenor defendants filed a separate motion to dismiss on the same day. On October 24, 2023, the District of Columbia and 17 states—Illinois, California, Colorado, Connecticut, Delaware, Hawai’i, Maine, Maryland, Massachusetts, Michigan, Minnesota, Nevada, New Jersey, New York, Oregon, Rhode Island, and Washington—with the leave of the Court filed an amici curiae brief in support of Defendants’ motions to dismiss. The parties proceeded with motion practice, and on January 31, 2024, the Court held a hearing regarding Defendants’ motions to dismiss.

This case was transferred to Magistrate Judge Brian McKay on August 23, 2024. After the court ordered parties to report whether the case should be deemed moot following the inauguration of President Trump in 2025, the parties jointly requested and received a 60-day stay on January 31, 2025. During this stay, the court waited for Secretary of Homeland Security Kristi Noem to decide whether the CAM program should be terminated. 

On June 6, 2025, the defendants were replaced by the court, most notably replacing President Biden, Secretary of State Antony Blinken, and Secretary of Homeland Security Alejandro Mayorkas with President Trump, Secretary of State Marco Rubio, and Secretary of Homeland Security Kristi Noem respectively. On September 8, 2025, the case was reassigned to Judge Sam A. Lindsay. 

In the meantime, the court granted multiple motions to extend the stay, with the last such order allowing the stay to continue until January 2026. As of May 2026, the case is ongoing.
