This is a case about property owners and brokers in New York City who allegedly refused to rent residential property to holders of Housing Choice Vouchers (which subsidized housing for low-income families). On March 15, 2021, the Housing Rights Initiative (HRI) filed this lawsuit in U.S. District Court for the Southern District of New York. HRI sued eighty eight property owners and brokers under the Fair Housing Act (FHA) and city and state laws that barred source of income discrimination. Represented by private counsel and the Legal Aid Society, HRI sought (1) injunctive relief ordering that the defendants end their policies or practices of not renting to holders of Housing Choice Vouchers, (2) a declaratory judgment that the defendants’ policies or practices violated the FHA and state and city law, and (3) money damages, punitive damages, and attorney’s fees and costs. HRI claimed that refusing to rent residential property to Housing Choice Voucher holders had an unlawful discriminatory effect based on disability and race in violation of the FHA and constituted source of income discrimination under New York State and New York City law. The case was assigned to Judge Sidney H. Stein.

Given the large number of defendants, the litigation proceeded slowly and in a disorderly manner. There were difficulties properly serving some of the defendants, and a number of defendants requested an extension of time to answer the complaint. During this protracted pleading stage, HRI voluntarily dismissed some of the defendants, and others filed unconsented motions for dismissal.

On November 19, HRI informed the court that it was planning to move for leave to file an amended complaint and requested that existing deadlines be extended. In response, the court postponed the deadline for HRI to respond to motions to dismiss and the deadline to answer the complaint for any defendants who had not yet done so. The new deadlines were twenty-one days after the court ruled on the motion to file an amended complaint or twenty-one days after the amended complaint was filed, whichever was later. On November 23, HRI moved for leave to file an amended complaint. The court granted leave and mooted outstanding motions to dismiss on December 6. HRI filed its amended complaint the next day. The amended complaint excluded the eleven defendants who had been dismissed prior to that date and minorly amended certain arguments.

In late December 2021, the defendants began answering the amended complaint. By early March, more than half of the remaining defendants had responded to the amended complaint. Most of the responding parties answered the amended complaint, but some filed motions to dismiss or other similar motions. By March 9, however, many defendants had still not responded to the amended complaint, and HRI began to file proposed clerk’s certificates of default. By March 21, the clerk had entered certificates of default for twenty three defendants.

On March 19, one of the defendants filed a motion to dismiss the action as against all non-appearing defendants. The motion argued that, although HRI properly served these parties with the original complaint, it failed to properly serve them with the amended complaint. HRI mailed the amended complaint to these parties pursuant to FRCP(5)(b)(2)(C). But, the motion argued, service should have been made pursuant to FRCP 4. The motion then explained that the time to serve the amended complaint had expired, and that the non-appearing defendants should be released from the action.

In an order filed on March 22, Judge Stein expressed her frustration with the case, stating: “It is time for this action to move forward in a more orderly fashion.” To that effect, Judge Stein directed HRI to file a status report by March 24 and ordered a status conference for March 25. 

In the status report, HRI explained that it had resolved its claims with eighteen of the original defendants. Many of these defendants, HRI claimed, entered non-monetary settlement agreements including some or all of following terms: “Higher commissions to agents who rent to voucher holders, dedicated staff to assist with voucher paperwork, training for individuals making leasing policies or interacting with prospective tenants, commitments to non-discrimination policies that explicitly cover source of income, posting signage regarding acceptance of vouchers in public-facing offices, reserving apartments for tenants with vouchers, commitments to training for individuals making leasing decisions or interacting with potential tenants, inclusion of the statement ‘housing choice vouchers welcome’ on advertisements, and development of internal auditing programs.” HRI stated that, of the seventy remaining defendants, forty three were actively participating in the litigation and twenty seven had failed to respond. As mentioned, HRI had obtained entries of default against twenty three of those twenty seven non-participating defendants. HRI explained that it had not pursued certificates of default against the final four defendants because it remained hopeful about its efforts to resolve its claims with these parties.

On March 25, the court denied, along with other motions, the motion to dismiss from the action all non-appearing defendants. The court explained that HRI acted properly in serving the amended complaint under FRCP 5(b). The amended complaint was “a pleading filed after the original complaint” and, seeing as it contained no new claims, did not require Rule 4 service under FRCP 5(a)(2). Additionally, the court provided one of the defaulting defendants, on consent of the plaintiff, ten days to reply to the amended complaint, and it instructed HRI regarding the process to pursue default judgments from the other defaulting defendants.

It also appears that, in early April 2022, HRI reached a settlement with another defendant.

Some defendants continue to file answers to the complaint. The case is ongoing.
