Case Summary

On April 15, 2022, six individuals who were at the time or formerly civilly-detained immigrants ("the plaintiffs") brought this lawsuit in the U.S. District Court for the Northern District of Illinois against McHenry County and the county's sheriff on behalf of themselves and all others similarly situated. The plaintiffs alleged violations of the federal Trafficking Victims Protection Act (“TVPA”) and state law because they were subjected to forced labor while housed at a detention center in Illinois. Specifically, the plaintiffs claimed that they were forced to perform various janitorial and maintenance services without compensation and against their will in violation of the TVPA and Illinois state law. As such, the plaintiffs sought certification of the proposed class and damages in an amount exceeding $5,000,000 in addition to attorney's fees. As of June 4, 2022, this case is ongoing.

MINUTE entry before the Honorable Margaret J. Schneider: Plaintiff's Motion to Compel Discovery 62, is denied without prejudice. Defendants have included information in their response brief 64, as well as through an affidavit from Sheriff Tadelman [64-1], that was not part of the meet and confer conferences held by the parties in their attempt to resolve this dispute. These details go directly to Defendants' argument that Plaintiff's requests for production of documents are overly broad and unduly burdensome. Therefore, the Court does not find the dispute ripe for the Court's review and directs the parties to continue to meet and confer in good faith. From the Court's reading of the briefs, the Court does forecast for the parties its inclination that while Plaintiff's waiver argument is not altogether persuasive, the Court would be inclined to agree with Plaintiff that the documents being sought are relevant to the litigation. The Court is confident the parties will be able to come up with creative solutions for producing relevant materials. The Court will, of course, take up any future motion to compel, if needed, but encourages the parties to work together to resolve disputes in an effort to move this litigation forward and make the best use of both the parties' and the Court's time.
