Case Summary

This is a voting rights case brought in 2006 by the United States against the City of Euclid, Ohio. At the time, Euclid used a combination of single-member districts and slotted, at-large positions, which resulted in the dilution of the voting strength of Black people. Under the combination of single-member and at-large/multimember districts, in elections since 1995 for the Euclid City Council, white voters consistently voted as a bloc to defeat every candidate preferred by Black voters. Under a properly apportioned single-member district plan, Black citizens would constitute a majority of the voting-age population in two of nine districts. On July 10, 2006, the U.S. filed a complaint in the U.S. District Court for the Northern District of Ohio, alleging that the City of Euclid’s current election system violated § 2 of the Voting Rights Act, and requesting that the court order the City to devise and implement a new election system compliant with the Voting Rights Act. 2006 WL 6498352.

In July 2006, the City moved to dismiss, which the court denied in October of that year. The court discussed why it denied the City’s motion to dismiss at the October 3, 2006 case management conference, but Clearinghouse is unable to ascertain those reasons at this time.

Discovery ensued, and the case went to trial in August 2007. At trial, the court applied the framework laid out by the U.S. Supreme Court in Thornberg v. Gingles. The court first found that the election system met the three preconditions laid out in Gingles: (1) The Black minority population of the City was sufficiently large and geographically compact enough to constitute a majority in at least one single-member district; (2) The Black minority voting population was politically cohesive; and (3) The white majority voted consistently as a bloc to defeat the minority’s preferred candidate. Indeed no Black candidate had ever won office in the City. Applying the totality of the circumstances approach laid out in Gingles, the court then found that Black voters in the City overall did not possess the same opportunities to participate in the political process as white voters. Black people in Euclid had suffered historical discrimination in housing, education, and employment, and they had a lower socioeconomic status and lower political participation, all of which hampered Black people’s access to equal political participation. 580 F.Supp.2d 584. Given these factors, the court held that the election system used by the City of Euclid violated Section 2 of the Voting Rights Act by diluting the voting power of Black people. Following the ruling, the court ordered the U.S. and the City to agree on a remedial election system by September 2007 and stayed the Euclid City Council elections until March 2008. 523 F.Supp.2d 641.

On October 29, 2007, the court approved the new election system, which created eight single-member districts within the City of Euclid while leaving intact the at-large office of the Euclid City Council president. The redrawn districts included two majority-minority districts with effective voting-age Black majorities of 60% or greater, both largely the result of existing residential patterns rather than specific, purposeful plan-drawing. Furthermore, on the nine-member council, two districts constituted 22.22% of the seats, which was roughly proportional to the overall percentage of the City’s Black voting-age population (27.8%). The new election plan remedied the existing Voting Rights Act violation without creating a new violation, and the plan was implemented in the City’s March 4, 2008 presidential primary election. 523 F.Supp.2d 641.
