On August 13, 2011, a deaf individual who communicated primarily through American Sign Language (ASL) was arrested by officers in the Englewood Police Department (EPD) who deprived him of access to critical medication for diabetes and auxiliary aids or services for effective communication. Throughout the process of the individual’s arrest, booking, and intake, his hearing disability was readily apparent and documented. On August 13, 2011, a deaf individual who communicated primarily through American Sign Language (ASL) was arrested by officers in the Englewood Police Department (EPD) who deprived him of access to critical medication for diabetes and auxiliary aids or services for effective communication. Throughout the process of the individual’s arrest, booking, and intake, his hearing disability was readily apparent and documented. The EPD failed to provide interpretive services or access to the individual’s medicine or food to regulate his blood sugar despite his repeated requests. Together with the Colorado Cross-Disability Coalition (CCDC) and the Colorado Association of the Deaf (CAD), the individual filed suit for damages in the District Court of Colorado against the City of Englewood, EPD, and the Sheriff of Arapahoe County in his official capacity on May 31, 2012. The lawsuit alleged violations of Section 504 of the Rehabilitation Act and Title II of the Americans with Disabilities Act (ADA). On June 8, 2012, plaintiffs filed an amended complaint to include a request for class certification and injunctive relief. The case was assigned to Judge Marcia S. Krieger and Magistrate Judge Boyd N. Boland. 

In addition to the lawsuit, plaintiffs filed a complaint with the Civil Rights Division of the U.S. Department of Justice (U.S. DOJ Complaint No. 204-14-311). The U.S. DOJ initiated an investigation into plaintiffs’ allegations while the lawsuit was in its early stages.  

On October 5, 2012, the court issued a protective order applicable to all documents, materials, deposition testimony, and other information disclosed through discovery and designated “Confidential.” While considering intervening in the private lawsuit, the U.S. DOJ contacted the parties to gauge whether there were grounds for a cooperative resolution. All parties responded with interest in a cooperative resolution and defendants expressed a commitment to ensure compliance with the ADA. On November 29, 2012, the parties and an attorney from the U.S. Department of Justice (U.S. DOJ) met. U.S. DOJ counsel subsequently conferred with both parties and drafted a proposed settlement agreement as a starting point for settlement negotiations between the parties. The parties filed a joint motion requesting a stay of discovery on the basis that they were close to concluding negotiations on settlement agreements on December 10, 2012.

On March 8, 2013, plaintiffs reached a settlement agreement with the city of Englewood. A companion settlement agreement was finalized with Arapahoe County Sheriff’s Office on March 21, 2013.The settlement agreements included both injunctive-like and monetary relief, with the City of Englewood and the Sheriff’s department agreeing to pay the named plaintiff a total of $70,000. The settlement agreements were effective for three years and included providing annual reports to the U.S. DOJ, which reserved the right to review compliance with the agreements at any time. Defendants were given sixty days to come into compliance with terms of the agreements. Terms included: designating an ADA Coordinator for law enforcement in Englewood; publishing a grievance procedure for actions prohibited under the ADA; provision of auxiliary aids and services (including qualified interpreters); consideration of an individual’s preference for auxiliary aids, reasonable modification of handcuffing policies; signs that advise deaf individuals of the availability of auxiliary aids and services; and training of law enforcement personnel. Defendants also agreed to not use other members of the public to facilitate communication with deaf individuals without their consent (except for in the case of an emergency). 

The case was dismissed with prejudice on April 11, 2013.
