This case concerns the allegation that the population of the Commonwealth of Kentucky shifted from 2000 to 2010 from rural areas toward more urban and suburban areas of Louisville, Lexington, and Northern Kentucky. Plaintiffs alleged that the redistricting plan passed in 2012 did not take this population shift into account, and that the Kentucky Supreme Court struck down this redistricting plan on April 26, 2012. Accordingly, plaintiffs sought injunctive relief to prohibit use of the then-current districts and to draw new, constitutional districts for the 2014 Kentucky House and Senate primary and general elections.

The Boone County (Kentucky) Clerk and eleven individuals filed this lawsuit on April 26, 2013, in the United States District Court, Eastern District of Kentucky, Covington Division. The individual plaintiffs included voters and candidates and potential candidates for public office. Plaintiffs were represented by private counsel and by the ACLU. The Commonwealth of Kentucky was the main defendant, and other defendants included the Governor, Secretary of State, Speaker of the House of Representatives (and that body), President of the Senate (and that body), the Kentucky State Board of Elections, the Kentucky Legislative Research Commission, and the Kentucky Attorney General. Defendants were represented by both private and government counsel. The case was heard by a three-judge panel that included District Judge William O. Bertelsman, District Judge Gregory F. Van Tatenhove, and Sixth Circuit Justice Daniel J. Boggs.

Plaintiffs asserted a claim for violation of equal protection under the United States Constitution, including under the Fourteenth Amendment pursuant to 42 U.S.C. Section 1983. Plaintiffs also sought declaratory relief under 28 U.S.C. Section 2201. Further, Plaintiffs asserted violations of Sections 3, 6, and 33 of the Kentucky Constitution, including a claim of violation of Section 6, which provides that "[a]ll elections shall be free and equal." For relief, Plaintiffs sought monetary damages, a declaration that the then-current maps were unconstitutional, injunctive relief prohibiting the use of those maps and directing that constitutional maps be drawn for the 2014 Kentucky House and Senate primary and general elections, and costs and attorneys' fees.

In their suit, Plaintiffs alleged that the population of Kentucky shifted from 2000 to 2010 from rural areas of the Commonwealth to more urban and suburban areas, particularly in Louisville, Lexington, and Northern Kentucky. The General Assembly passed a redistricting plan in January 2012, but those maps were struck down by the Franklin Circuit Court on the ground that those were unconstitutional under the Kentucky Constitution. The Kentucky Supreme Court subsequently upheld that decision in April 2012. Further, the 2013 legislative session ended without the passage of a redistricting plan. Accordingly, the maps drawn in 2000 were to be in effect for the 2014 elections, and Plaintiffs alleged that those maps unconstitutionally deviated too far from the ideal districts for both the House and Senate given the population shift from 2000 to 2010. Plaintiffs also alleged that one of the proposed plans impermissibly excluded prisoner populations. As a result, Plaintiffs alleged that their votes were significantly diluted in violation of the Equal Protection Clause.

Several defendants filed motions to dismiss, motions for judgment on the pleadings, or counter- or cross-claims regarding the requested redistricting, or some combination of these. Some of the counter- and cross-claims were the subjects of motions to dismiss as well. The Attorney General and the Commonwealth were dismissed by agreement, and a stipulation of dismissal was filed as to the Kentucky State Board of Elections. All other defendants remained in the case.

The panel granted the parties' motion to consolidate cases with Herbert v. Kentucky State Board of Elections (Civil No. 13-cv-25), which concerned the same issues. The panel ordered that all pleadings be filed in the Brown case.

In July 12, 2013, less than four months after filing the lawsuit, Plaintiffs filed their Joint Motion for Summary Judgment. In that Motion, Plaintiffs requested a declaration that Kentucky's existing House and Senate legislative districts - which had been enacted in 2002 - were impermissibly mal-apportioned in violation of the Fourteenth Amendment's Equal Protection Clause. They also sought a permanent injunction barring Defendants from using the current districts in any future elections.

On August 16, 2013, three days before the start of a special legislative session scheduled for redistricting, the judicial panel issued its Memorandum Opinion & Order granting the relief sought. (See 966 F. Supp. 2d 709.) The Court granted the motion for summary judgment, declared the 2002 state legislative districts unconstitutional, and permanently enjoined any future election from being conducted using those districts. The Court noted that its Order did not prevent the Kentucky General Assembly from crafting redistricting legislation during an August 19, 2013 special legislative session. But, the Court further noted that its Order prevented the General Assembly from falling back on the old lines, should the redistricting effort fail.

Subsequently, on October 31, 2013, the Court issued its Permanent Injunction. By this injunction, the Court permanently restrained and enjoined Defendants from administering further elections using the 2002 State legislative electoral districts.

At the special session, the General Assembly adopted legislative maps. Accordingly, on August 29, 2013, Plaintiffs filed a Joint Motion to Enter Final Judgment. Plaintiffs moved the Court for a final judgment that incorporated the declaratory and injunctive relief previously granted. The Court granted this Motion by Order dated October 31, 2013. (See 2013 WL 12320875.)

The Court then addressed Plaintiffs' motions for attorneys' fees, granting their requests in a Memorandum Opinion and Order dated January 27, 2014, and referring Defendants' objections as to the reasonableness of the fees to United States Magistrate Judge J. Gregory Wehrman, of the Eastern District of Kentucky. (2014 WL 295490.) Based on Judge Wehrman's Report and Recommendations (2014 WL 12862253), the Court issued an Order on July 28, 2014, grating plaintiffs' respective attorneys fees in the total amount of $173,158.50. (2014 WL 12862645.) On September 25, 2014, the parties submitted a Joint Notice of Satisfaction of Judgment.
