This is a case about voting access for individuals who registered through public assistance agencies in Louisiana. 

On April 19, 2011, a Louisiana voter and the Louisiana State Conference of the NAACP brought this action for injunctive relief under the National Voter Registration Act against the Defendants Louisiana Secretary of State, Louisiana Department of Health and Hospitals, and the Louisiana Department of Children and Family Services. The plaintiffs alleged that Defendants engaged in systemic and ongoing violations of their obligations under Section 7 of the NVRA by failing to offer voter registration services to all people who applied for, renewed, or changed their addresses in connection with public assistance benefits. Plaintiffs also alleged that the Louisiana Secretary of State had violated the NVRA by failing to coordinate the state's responsibilities under the Act. Plaintiffs last claimed that defendants’ behavior violated state voting law. The case was assigned to Judge Lance M Africk and Magistrate Judge Joseph C. Wilkinson, Jr., and later reassigned to Judge Jane Triche Milazzo. 

On June 2, 2011, each defendant filed a separate motion to dismiss. 

On July 21, 2011, the court granted and denied in part the defendants’ motions to dismiss. The court denied the plaintiffs’ state claims while upholding the NVRA claims. 

On January 3, 2013, following a trial on the merits, the court found the Defendants violated the NVRA in various ways and a permanent injunction was entered against all Defendants which included an attorneys’ fee award of $355,489.38 and a reasonable costs award of $34,251.57. Judgement was entered on October 22, 2013. 

On February 19, 2013, a notice of the Defendant's appeal for a reduction in attorney’s fees was given to the Court. This appeal was decided in 2016, wherein the Fifth Circuit Court of Appeals granted it in part and denied it in part. The Defendant in his official capacity, must pay $94,797.17 in reasonable attorneys fees and $9,133.75 in reimbursable expenses. He was found to be jointly and severally liable with his co-Defendants. It was further ordered that judgment be in favor of Plaintiffs in the amounts of $236,992.92 in reasonable attorneys fees and $22,834.38 in reimbursable expenses.

This case is now closed.
