This is a case about inadequate medical care in prisons. On February 2, 2017, a prisoner within the Nevada Department of Corrections (“NDOC”) filed a complaint pro se in the United States District Court for the District of Nevada against the NDOC and the correctional facility doctor in charge of his care. The case was assigned to Judge Miranda M. Du, who screened and dismissed the original complaint. 2018 WL 11395017. Plaintiff then filed a first amended complaint under 42 U.S.C. § 1983 on February 27, 2018, alleging deliberate indifference to serious medical needs in violation of the Eighth Amendment. Plaintiff sought monetary damages and injunctive relief. He claimed that a prior injury had rendered him blind in one eye, and although doctors told him that surgery might improve his vision, NDOC never referred plaintiff to an ophthalmologist once he was transferred into their custody. Plaintiff further alleged that this failure to provide medical treatment stemmed from an NDOC policy to not evaluate or offer corrective eye surgery to prisoners who can see out of one eye.  

The court scheduled an Inmate Early Mediation Conference, which was held on July 7, 2019, but the parties were unable to reach a settlement agreement. In August, private counsel appeared on behalf of the plaintiff and filed a second amended complaint, bringing a claim under Title II of the Americans with Disabilities Act (“ADA”) against the NDOC and an Eighth Amendment claim against the prison doctor. 2019 WL 13130527. 

On November 19, 2019, plaintiff filed a motion for preliminary injunction seeking to enjoin NDOC’s “one-good-eye” policy. He also sought to expunge a disciplinary conviction levied for abusing the prison’s grievance process, which he had utilized in an attempt to exhaust administrative remedies regarding his ADA claim. Shortly after, plaintiff also filed a motion for partial summary judgment on the issues. The court heard the motions on March 2, 2020, and ordered that the motions be held in abeyance for 90 days so that plaintiff could be seen by an ophthalmologist for an eye surgery consultation and defendants could discuss the disciplinary conviction. 

On March 15, 2020, plaintiff filed a motion for leave to file a third amended complaint adding a retaliation claim under Title II of the ADA, indicating that NDOC had refused to expunge the disciplinary conviction. To update the previous motion for partial summary judgment, plaintiff filed a supplement stating that he was seen by an ophthalmologist who recommended cataract surgery. By June 30 though, the court had not received information as to whether the plaintiff had received the surgery. 

On July 22, plaintiff filed a third amended complaint. 2020 WL 4207057. In a July 24 Report and Recommendation, Magistrate Judge William G. Cobb found that the plaintiff’s motions for partial summary judgment and preliminary injunctive relief were directed at the second amended complaint and were thus superseded by the third amended complaint. 2020 WL 4589978. On August 10, the court adopted the magistrate’s Report and Recommendation and denied the plaintiff’s motions. 2020 WL 12933755. 

On August 24, the court scheduled a settlement conference for October 15, 2020. The parties met on that date, but were unable to reach an agreement. On January 28, 2021 the court ordered the parties to confer on the matter of the disciplinary charge—suggesting that if the charge were expunged, the plaintiff’s ADA retaliation claim would be rendered moot. 

The magistrate submitted another Report and Recommendation on February 5, 2021. 2021 WL 1397230. Notably, the report states that plaintiff received cataract surgery at some point after filing the third amended complaint, but that his eyesight had not returned. The magistrate also recommended that the court deny plaintiff’s motion for partial summary judgment with respect to his retaliation claim under Title II of the ADA. To support this conclusion, the magistrate cited a dispute of fact as to whether plaintiff was disciplined in retaliation for exercising his right to exhaust administrative remedies, or whether he was disciplined for filing duplicative grievances raising the same issue, which constitutes an abuse of the grievance process under NDOC regulations. Judge Du adopted the magistrate’s recommendations in full on March 17 and denied plaintiff’s summary judgment motion. 2021 WL 1041912. 

On September 20, 2021, the court issued a pretrial order scheduling a bench trial on the ADA claim and a jury trial on the other claims for 2022. 

The parties reached a settlement agreement and filed a joint stipulation for dismissal with prejudice on March 25, 2022. NDOC agreed to pay plaintiff $7,500 and to expunge the disciplinary charge from his record. NDOC also agreed to change its policy for prisoners with monocular blindness, prohibiting employees from denying prisoners consideration for corrective surgery solely on the basis that the prisoner can see out of one eye. (NDOC retained the authority to deny corrective surgery that is not medically necessary, or is likely to be unsuccessful.) The parties agreed that the court would determine attorneys’ fees and costs. NDOC admitted no liability.  

Plaintiff filed a motion for attorneys' fees, which the court granted in part and denied in part on July 15, 2022. The court found that the Prison Litigation Reform Act’s fee limit caps did not apply, and awarded plaintiff $560,587.50 in attorneys’ fees and $1,948.12 in costs. 

Defendants appealed the order on attorneys fees to the United States Court of Appeals for the Ninth Circuit on August 10, 2022. The parties then agreed to settle the case for $463,597.12 in attorneys’ fees and $1,948.12 in costs. On January 18, 2023 plaintiff notified the court that defendants had satisfied the judgment and the Court of Appeals voluntarily dismissed the appeal upon joint stipulation by the parties.
