On November 10, 2021, the U.S. Department of Justice (DOJ) sued Uber in the U.S. District Court for the Northern District of California for violating the Americans with Disabilities Act (ADA) by charging wait time fees for passengers that needed more than two minutes to get into a car. There are various disability-based reasons for which a passenger may need more than two minutes, such as needing time to break down a wheelchair and put it in the car. The DOJ sought (1) a declaratory judgment that Uber violated Title III of the ADA by failing to reasonably modify its wait time fee policy for passengers with disabilities, (2) injunctive relief prohibiting Uber from engaging in this type of discrimination and requiring Uber to modify its policies and training to comply with the ADA, and (3) monetary damages, including compensatory damages for emotional distress and other injuries, and a civil penalty. This case was first assigned to District Judge Donna M. Ryu and then reassigned to District Judge William Alsup on November 26, 2021.

On January 14, 2022, Uber filed a motion to dismiss, to which the DOJ responded on February 4, 2022. The response claimed that Uber is a covered transportation company under Title III of the ADA and that the time-based fee for people who need more than two minutes to board as a result of their disability is a violation of Title II’s regulations. The motion was denied by the Court for reasons provided orally during a hearing on April 13, 2022.

On July 18, 2022, the DOJ announced that the parties had reached a multi-million-dollar settlement and the case was dismissed on July 28, 2022. The settlement required Uber to pay $500,000 to compensate DOJ Complainants (individuals who communicated with the DOJ regarding Uber’s wait time fees prior to the settlement and whom the United States identifies as eligible to share in the payments), $1,738,500 to compensate Uber Complainants (the 1,159 persons, excluding DOJ Complainants, whom Uber has previously identified as having communicated with Uber about incurring a wait time fee at the start of a trip and indicating that a disability contributed to their inability to board a vehicle within two minutes), and a $50,000 civil penalty to the United States. These claims will be handled by an independent Fund Administrator, who will give each complainant notice for payment. Uber also agreed to waive time-based fees for all Uber riders who certify that they need more time to get in an Uber because of their disability, and to make refunds available for anyone who is charged a wait time fee because of their disability. Though Uber cannot require a user to disclose a specific medical diagnosis, provide medical documentation, or sign a medical release, it may require a description of the general nature of a rider’s disability. To advertise this, Uber agreed to make a description of the Waiver Program available on the Uber app, their U.S. website, and as part of an onboarding email for new riders in the United States. To support this program, Uber also agreed to provide mandatory training to all current members of Uber’s Accessibility and Disability Team describing the changes. 

Under the settlement agreement, the court will retain jurisdiction for enforcement purposes until July 15, 2024.
