In 1995, the Montana Legislature passed a law restricting the performance of abortions to licensed physicians. The new law effectively overturned a previous state law, in effect since the early 1970s, which had been interpreted to allow physician assistants to perform abortions under the supervision of a physician. On July 31, 1995, a physician assistant who provided abortions and other medical professionals challenged the law in the United States District Court for the District of Montana, claiming that the new law imposed an undue burden on a woman’s right to choose to have an abortion and that this burden was the constitutionally impermissible objective of the Montana legislature in creating the law. Plaintiffs sought declaratory, preliminary, and permanent injunctive relief. This case was assigned to District Judge Paul G. Hatfield in the United States District Court for the District of Montana.

Judge Hatfield, on September 29, 1995, denied the preliminary injunction in regards to the law restricting the performance of abortions to licensed physicians, concluding that it was unlikely that Plaintiffs could prevail on their "unduly burden" argument. Thus, the court allowed the state to continue to prohibit physician assistants from performing abortions. 906 F. Supp. 561 (D. Mont. 1995). Plaintiff filed an appeal on Oct. 2, 1995 in the US Court of Appeals for the Ninth Circuit.

On August 27, 1996, the US Court of Appeals for the Ninth Circuit vacated the district court's order denying preliminary relief and remanded the case to the district court to engage in a proper balancing of the hardships. 94 F.3d 566 (9th Cir. 1996). On November 5, 1996, the district court granted an injunction pending appeal, allowing the Plaintiff physician assistant to continue performing abortions under the supervision of a physician. In response, the state filed for a writ of certiorari to the U.S. Supreme Court. The district court postponed a hearing on the preliminary injunction motion until the Supreme Court made a decision on the state attorney general's certiorari petition. 

On June 16, 1997, the Supreme Court reached its decision without oral argument or full briefing. The Supreme Court reversed the judgment of the Court of Appeals and remanded the case for further proceedings consistent with its judgment. The Supreme Court determined that the Ninth Circuit's decision was clearly erroneous based on Supreme Court precedent that the performance of abortions may be restricted to physicians, on the opinion that there was no legislative purpose here that would make the claim invalid, and that the physician-only requirement at issue did not pose a "substantial obstacle to a woman seeking an abortion" and was thus not an undue burden. 520 U.S. 968.

Judge Paul G. Hatfield then granted a motion to dissolve the injunction on September 19, 1997, and the case was dismissed on January 15, 1998, with each party to bear their own costs.

Plaintiffs, again represented by the Center for Reproductive Rights, then filed a lawsuit in state court, alleging that this law violated the Montana State Constitution’s provisions regarding privacy, due process, and equal protection of the laws. Read more about the state claim here.
