On July 8, 2022, the Wisconsin Supreme Court reversed a decades-old precedent that allowed people with disabilities to receive assistance from family members and caregivers in submitting their ballot. In Teigen v. Wisconsin Elections Commission, the court construed Wisconsin statute § 6.87(4)(b)1 to mandate that voters with disabilities return their ballot by mail, or in person themselves. The court expressly refused to consider whether voters with disabilities were entitled to assistance when submitting their ballot by mail. However, six days later, on July 14, 2022, the administrator of the Wisconsin Election Commission, Meagan Wolfe, stated at a press conference that “the voter is the one required to mail their ballot.”

Just over a week later, on July 22, 2022, four plaintiffs, all voters with disabilities, filed this lawsuit in the U.S. District Court for the Western District of Wisconsin. The voters sued the Wisconsin Elections Commission and Administrator Wolfe in her official capacity under Section 105 of the Voting Rights Act (VRA), Title II of the Americans with Disabilities Act (ADA), Section 504 the Rehabilitation Act, and the First and Fourteenth Amendments of the U.S. Constitution. Represented by Law Forward, a nonprofit and nonpartisan impact litigation firm, and other private counsel, the voters sought a declaration of their rights under federal law, an order enjoining the commission from enforcing the Wisconsin statute § 6.87(4)(b)1 against them, and an order directing the commission to instruct municipal clerks on their duty to accommodate voters with disabilities. 

Plaintiffs were all individuals who, because of their disabilities, were unable to perform the required act of holding their ballot themselves and delivering it to a mail carrier or municipal clerk. They claimed that the Wisconsin statute was preempted by the VRA and other federal laws. Plaintiffs argued that, because federal laws required that voters with disabilities be given assistance by a person of their choosing, enforcing the Wisconsin statute in a manner that contradicted the VRA was impermissible. The case was assigned to Judge James Donald Peterson.

Plaintiffs filed a preliminary injunction on July 27, 2022. When asked at the hearing for the injunction, neither party felt further factual development was necessary, so the motion for the injunction was converted to one for summary judgment.  On August 31, 2022, the court issued a declaration of plaintiffs’ rights under the VRA and found that, because the VRA provided the voters with complete relief, it was unnecessary to consider their other claims. The permanent injunction enjoined the commission and Administrator Wolfe from enforcing the statute against voters with disabilities for receiving assistance from a third party in mailing or delivering their absentee ballot. Defendants were also required to provide written instructions to all Wisconsin municipal clerks that the VRA requires that any Wisconsin voters who require assistance with mailing or delivering their absentee ballots to the municipal clerk because of a disability must be permitted to receive such assistance.
