Georgia NAACP v. State of Georgia

This is a case about protecting the power of voters of color in Georgia. On December 30, 2021, the Georgia NAACP, the Georgia Coalition for the People's Agenda, Inc. (GCPA) and the Galeo Latino Community Development Fund, Inc. (Galeo) filed this lawsuit in the United States District Court for the Northern District of Georgia. Appointed to the case was a three-judge panel comprised of District Judges Steven D. Grimberg and Steve C. Jones and Circuit Judge Elizabeth L. Branch. The plaintiffs sued the State of Georgia, the Georgia Governor, and the Secretary of State of Georgia under the Fourteenth Amendment's Equal Protection Clause and Section 2 of the Voting Rights Act of 1965.

Represented by private law firms and the Lawyers' Committee for Civil Rights under Law, the plaintiffs sought a permanent injunction against defendants that prohibits defendants from calling, holding, supervising, or certifying any election under the redistricting plans for the Georgia Senate (SB 1 EX/AP), Georgia House of Representatives (HB 1EX LC 47 1163S/AP), and Congress (SB 2 EX/AP) and further requested the creation of revised redistricting plans that do not infringe upon the constitutional rights of Georgians of color by diluting their voting strength.

Common Cause v. Raffensperger

On January 7, 2022, Common Cause, the League of Women Voters of Georgia, and three individual Black voters filed a similar lawsuit, Common Cause v. Raffensperger. In Common Cause, the plaintiffs, represented by the Southern Poverty Law Center and a private law firm, sought a permanent injunction against defendants from holding elections in Districts 6, 13, and 14 as enacted in S.B. 2EX and any other districts necessary to remedy the constitutional violations. They claimed that Districts 6, 13, and 14 were drawn using race as the predominant factor in determining the boundaries.

The Common Cause plaintiffs alleged this action was not narrowly tailored to advance compliance with the Voting Rights Act because Black voters and other voters of color were either packed into districts in substantially higher numbers than necessary or spread across multiple districts preventing the formation of a majority-minority district or minority opportunity district. The same three judges in the NAACP case were assigned to this case as well.

Consolidation

The Court recognized the similarities between the two cases, and recommended consolidating them. Plaintiffs supported consolidation for each claim, except for the Voting Rights Act claim whereas defendants supported consolidation for all claims. After hearing from the parties, the court consolidated the cases on February 3, 2022 due to the common questions of law and fact.

As of November 7, 2022, the case is ongoing and the parties are currently engaged in discovery.
