Louisiana officials announced that they would incarcerate about two dozen children in the former death row of the Louisiana State Penitentiary (commonly referred to as Angola) after Chief District Judge Shelly D. Dick signed off on the transfer. On August 19, 2022, plaintiffs, represented by the ACLU, filed suit against Governor John Bel Edwards, Deputy Secretary of the Office of Juvenile Justice William Sommers, and Secretary of the Louisiana Department of Public Safety & Corrections James M. Leblanc in the U.S. District Court for the Middle District of Louisiana to try and stop the transfers. The named plaintiff brought this class action on behalf of himself and all current and future people facing transfer from Bridge City Correctional Center for Youth (BCCY) to Louisiana State Penitentiary or another adult prison. 

Louisiana officials announced the plan due to security problems at BCCY. Plaintiffs contend this response was misguided and that by transferring youth to a maximum-security adult prison, Louisiana officials showed deliberate indifference to the plaintiffs' health and safety and therefore violated their Fourteenth Amendment rights. Furthermore, for the plaintiffs with disabilities, the required educational and rehabilitative services would not be provided in the adult prison in violation of Section 504 of the Rehabilitation Act of 1973.  

On August 19, 2022, plaintiffs filed a motion for a temporary restraining order that included a request for a preliminary injunction. The court denied the temporary restraining order on August 23, 2022 because it would decide the preliminary injunction question before any of the transfers were scheduled to begin. On September 23, 2022, Chief District Judge Dick, despite describing the prospect of sending teenagers to a maximum-security adult prison as "disturbing," denied the preliminary injunction on the grounds that there was no better option to protect other incarcerated youth at BCCY and the transfers were allowed to proceed.

Since late October 2022, OJJ incarcerated a total of between 70 and 80 youth, some as young as 15, in Angola.

Plaintiffs submitted an amended class action complaint on October 25, 2022. In the amended complaint, plaintiffs added class action claims under the ADA. Plaintiffs alleged that an estimated 70% of youth incarcerated nationwide had disabilities. Given that youth with disabilities were overrepresented in the system, plaintiffs alleged that it was highly likely that some youth who would be transferred to Angola would have disabilities and wouldn’t receive the care they needed, in violation of the ADA. 

On November 21, 2022, defendants submitted a motion to dismiss plaintiffs’ claims for lack of standing. The next day, defendants submitted a motion for a stay of discovery pending resolution of their motion to dismiss. Defendants also made an ex parte request to expedite consideration of the stay. The court denied expedited consideration on November 30, 2022, ordering plaintiffs to respond to the motion to stay. The court granted the stay on January 4, 2023. The motion to dismiss was still pending before the court when plaintiffs requested leave to amend the complaint once again, on April 6, 2023. The court denied the request to amend without prejudice, giving plaintiffs leave to refile their motion after the court issued a decision on defendants’ motion. 

Plaintiffs submitted another motion for a preliminary injunction on July 17, 2023. Plaintiffs alleged that, despite their assurances to the court, defendants had not given youth at Angola temporary therapeutic placements. Rather, they alleged, defendants regularly confined young people in prolonged isolation, failed to provide them the educational and other services promised, and subjected them to excessive heat and other dangerous living conditions. The court set a hearing date for August 15, 2023, and ordered defendants to withdraw their motion to dismiss by July 21, 2023, if they had the intention to do so. Defendants withdrew the motion on July 21, 2023. 

The Department of Justice’s Civil Rights Division (DOJ) filed a statement of interest in the matter on behalf of plaintiffs on July 28, 2023. The statement drew attention to the irreparable harms the youth faced if they were continued to be incarcerated in Angola, due to their harmful conditions of confinement and periods of prolonged isolation. Among other things, the DOJ highlighted plaintiffs’ allegations that there were no teachers to provide youth instruction, there was inadequate access to recreation and exercise, excessive heat, a lack of adequate ventilation, and inadequate access to safe drinking water. The DOJ’s statement explained that many of the youth incarcerated at Angola likely had a history of trauma, and these conditions were highly likely to cause psychological harm and to their suffering.

On August 10, 2023, defendants filed a motion to remove one of plaintiffs’ attorneys. The court ruled on the motion the next day, finding that plaintiffs’ counsel inappropriately communicated ex parte with a witness. The witness was being deposed remotely by video to provide opinion testimony, during which counsel communicated with them by text, pointing them to factual evidence. The court denied defendants’ request for further sanctions, but granted expert video testimony on the matter.

Plaintiffs’ motion for class certification was granted on August 31, 2023. 2023 WL 5628592. The proposed class consisted of all current and future youth in OJJ custody who had been, would, or could be held at Angola or another adult prison. The subclass consisted of current and future youths with disabilities who were, would be, or had the potential to be transferred to Angola or another adult prison. The court found that plaintiffs had adequately demonstrated adequacy of representation, as well as the standard numerosity, commonality, and typicality requirements. 

A week after granting class certification, the court granted plaintiffs’ July 2023 motion for a preliminary injunction on September 8, 2023. 2023 WL 5984280. Defendants were ordered to remove youth from Angola within the week, with a deadline of September 15. The court found the record showed defendants locked children in cells for days at a time as a form of punishment; punished youth with handcuffs, mace, and denial of family visits; failed to provide adequate staffing (including no licensed social worker or professional counselor); failed to provide appropriate education and special education where necessary, and failed to provide necessary and appropriate mental health treatment. 

The court evaluated the likelihood of success of plaintiffs’ claims regarding conditions of confinement by applying the deliberate indifference standard under the Eighth Amendment. Under this standard plaintiffs had to satisfy both an objective and subjective requirement, showing that a person was incarcerated under conditions posing a substantial risk of serious harm, defendants were aware of facts from which they could draw the inference that the risk existed, subjectively drew the inference that the risk existed, and then disregarded the risk. The court found that enough evidence had been presented to reach the conclusions that 1) cell restrictions as used at Angola were de facto solitary confinement, both in use and affect, and 2) defendants had knowledge of the serious harms posed by solitary confinement, but were  indifferent to the risk. The court also found that the excessive confinement of youth in their cells, untrained and undocumented use of handcuffs, Angola corrections officers’ use of mace, and systematic denial of family interactions for punitive reasons violated the Fourteenth Amendment. Finally, the court held that plaintiffs had successfully demonstrated that youth with disabilities in Angola were being denied necessary services to which they were entitled to as a matter of law. As a result, the court concluded that plaintiffs were substantially likely to succeed on the merits of their claims. 

Plaintiffs had previously demonstrated irreparable harm, and new evidence had added further psychological harms; as caused by being in adult prison cells, excessive and/or unwarranted cell restriction and macing, and the lack of education, mental health, and rehabilitative services. Finally, the court found that what changed in the 10 months since plaintiffs’ had first requested a preliminary injunction in September 2022 was the OJJ’s broken promises to protect the constitutional rights of the youth incarcerated at Angola, weighing the balance of harms and public interest in their favour. 

On September 11, 2023, defendants appealed the orders granting the injunction and class certification, as well several rulings issued on discovery disputes. They also requested a stay of the injunction pending appeal. The District Court denied the stay the next day, but the U.S. Court of Appeals for the Fifth Circuit granted a stay on September 14.

As of October 2023, motions on attorneys fees remain pending before the District Court, and the appeal remains pending before the Fifth Circuit.
