On May 23, 2018, in the United States District Court for the Southern District of Ohio, the Ohio A. Philip Randolph Institute, League of Women Voters of Ohio, and several individuals (collectively, “Plaintiffs”) filed a lawsuit against Ohio Governor John Kasich, Secretary of State of Ohio Jon Husted, Speaker Pro Tempore of the Ohio House of Representatives Kirk Schuring, and the President of the Ohio Senate Larry Obhof in their official capacities (collectively, “Defendants”). The Ohio A. Philip Randolph Institute was an alliance of African American trade unionists and community activists. Plaintiffs both sued on behalf of their members, alleging the gerrymandering map impaired their work by making it more difficult to engage with voters through education, registration, and outreach efforts. Represented by the ACLU Foundation, Plaintiffs sought a declaration that the gerrymandering map violated the First Amendment, Fourteenth Amendment, and Article I of the United States Constitution, and sought an order that enjoined any future elections under the map and required a new map to be implemented. By Order on June 1, 2018, U.S. Sixth Circuit Court of Appeals Chief Judge R. Guy Cole appointed a three-judge panel of U.S. Sixth Circuit Court of Appeals Judge Karen N. Moore, U.S. District Court Judge Michael H. Watson, and U.S. District Court Judge Timothy S. Black for the remainder of the lawsuit. 

In Plaintiffs’ Complaint, Plaintiffs alleged that in 2010 the Republican State Leadership Committee formulated a strategy to solidify Republican control of the state legislature and implemented “the REDistricting Majority Project.” The Ohio General Assembly had the primary authority to draw Ohio’s U.S. congressional districts. To adopt the congressional map, a majority of both the Ohio House of Representatives and the Ohio State Senate had to approve it, and the Governor of Ohio had to sign it into law. The Ohio General Assembly introduced the proposed redistricting map and plan in Ohio House Bill 319 (“H.B. 319”), as amended by Ohio House Bill 369 (“H.B. 369”). Plaintiffs alleged that the initial map set forth in H.B. 319 was kept from the public and members of the General Assembly until two days before the Ohio House of Representatives would vote on the bill. The Republican National Committee conducted a training session on redistricting and the theme was “keep it secret, keep it safe.” In doing so, map drawers and Ohio Republican officials often used their personal emails to conduct and discuss state congressional map drawing until shortly before H.B. 319 and H.B. 369 were signed into law on September 26, 2011, and December 15, 2011, respectively, which limited bipartisan input and introduction of alternative maps. Plaintiffs alleged that Republicans consistently retained 75% (12 of 16) of the seats in all three congressional elections cycles held under the congressional map, and that all measures commonly used to detect and measure the effects of partisan gerrymandering indicated that the map was “an extreme partisan gerrymander.” 

Plaintiffs noted in the Complaint that partisan symmetry is the principle that congressional maps should give voters of both parties a similar opportunity to elect their candidates of choice. Plaintiff alleged that on May 8, 2018, Ohio voters approved “Ballot Issue 1,” a reform measure that would govern the congressional redistricting process in Ohio with the goal of greater partisan symmetry to go into effect in 2022; however, there is no additional information provided in the complaints, pleadings, or other court documents as to the results of Ballot Issue 1 on recent elections. 

On July 20, 2018, Defendants filed both (a) a motion to dismiss and (b) a motion of Republican Congressional Delegation, Ohio Voters, and Republican Party Organizations to Intervene wherein Defendants requested that certain representatives from the U.S. House of Representatives from the challenged districts be permitted to intervene in the lawsuit as a matter of right or, in the alternative, as permissive intervenors (the “Intervenors”). The Court denied the Motion to Dismiss on August 15, 2018. The Motion to Intervene was granted on August 16, 2018, and the Intervenors filed an answer to the Complaint on August 28, 2018, further requesting the Court to dismiss the lawsuit. 

Defendants stated in the Motion to Intervene that although Plaintiffs alleged voters were diluted by the congressional map, Plaintiffs did not allege districts were malapportioned and argued instead that votes were diluted because of “ideological composition of the voters in [its] districts [made] it less likely that [its] preferred candidates [would] win.” 

On January 8, 2019, Defendants moved for summary judgment. Defendant’s motion for summary judgment was denied on February 15, 2019. In its order, the Court stated partisan gerrymandering claims are justiciable and Plaintiffs had established the necessary preliminary evidence of (1) partisan intent, (2) partisan effect, and (3) causation or lack of legitimate justification for the challenged district’s design.

An eight-day bench trial was held from March 4, 2019 to March 13, 2019. On May 3, 2019, the Court granted Plaintiff’s request to declare the redistricting plan enacted in H.B. 369 unconstitutional and also granted Plaintiffs’ request for injunctive relief, which enjoined the State of Ohio from conducting any further elections using the congressional plan enacted in H.B. 369. The Court stated “several takeaways were universal: (1) the Ohio map sacrifice[ed] respect for traditional districting principles in order to maximize pro-Republican partisan advantage, (2) the Ohio map’s pro-Republican partisan bias [was] extreme, compared both to historical plans across the United States and to other possible configurations that could have been adopted in Ohio, and (3) the Ohio map minimize[ed] responsiveness and competition, rendering one consistent result no matter the particularities of the election cycle.” Based on this evidence, the Court found that the partisan gerrymander was “intentional and effective” and there was “no legitimate justification” for its extremity. 

Defendant appealed the order to the U.S. Court of Appeals for the Sixth Circuit on May 6, 2019 (case no. 18-4258). The same day, the defendants asked the district court to stay the injunction pending appeal. The district court denied that motion a few days later, on May 9, and the next day the defendants asked the Supreme Court for an emergency stay pending appeal (case no. 19-110). The Supreme Court granted the stay on May 24, 2019.

On October 7, 2019, the Supreme Court remanded the case back to the district court to decide how it was affected by the Supreme Court's recent ruling in Rucho v. Common Cause, which held that partisan gerrymandering is a political question that the courts cannot weigh in on. The plaintiffs moved to dismiss the case for lack of jurisdiction a few days later, on October 11, and the court dismissed the case on October 29, 2019. The defendants requested that the plaintiff pay their litigation costs, but the court denied the request on February 4, 2020.

Minute Entry and Notation Order: Upon the parties' joint request for an initial telephone conference to discuss the case calendar, this case came before Judge Timothy S. Black by telephone on 6/12/18 at 2:30 p.m. Freda Levenson, Theresa Lee, Peter Rechter and Robert Fram appeared on behalf of Plaintiffs; Nicole Koppitch, Halli Watson and Renata Staff appeared on behalf of Defendants. Judge Black held that Defendants are entitled to an extension of time to respond to the Complaint until two weeks after the Supreme Court is expected to issue a decision in Gill and Benisek. Judge Black also held there was good cause for expedited discovery because of the potential harm to plaintiffs and the public if this case is not resolved sufficiently timely for Supreme Court review before the 2020 election. Accordingly, the Court sets the following initial case schedule: Plaintiffs are ordered to serve their initial discovery requests by 6/15/18; Defendants shall respond to the Complaint by 7/13/18; Defendants shall respond to Plaintiff's initial discovery requests by 7/13/18. The parties shall confer as required by Rule 26(f) as soon as practicable after the Supreme Court's decisions in Gill and Benisek and file their report forthwith. Minute Entry and Notation Order: This case came before the Court for a discovery status conference by telephone on 7/25/18 at 4:00 p.m. Robert Fram, Michael Baker, and Theresa Lee appeared on behalf of Plaintiffs; Phillip Strach, Steven Voigt, and Nicole Koppitch appeared on behalf of Defendants. The Court addressed the following issues: Document Production. Defendants (as well as third-parties represented by counsel for Defendants) shall produce documents responsive to Plaintiffs' discovery requests and subpoenas on a rolling basis beginning 8/3/18; all responsive documents shall be produced by 8/30/18. On 8/30/18, Defendants (as well as third-parties represented by counsel for Defendants) shall identify what responsive documents, if any, have been withheld pursuant to an objection (and for each such document, identify the objection). Defendants' Answers to Plaintiffs' Interrogatory. Defendants shall use their best-faith efforts to supplement their answers to Plaintiffs' interrogatory no. 1 by 8/8/18, including determining whether Heather Blessing (Mann) or Ray DiRossi provided non-secretarial assistance in the redistricting of the Ohio congressional maps in 2011. Defendants shall supplement this answer again, if applicable, after completing document production. Legislative Privilege. This case is set for another status conference by telephone on 8/31/18 at 2:00 p.m. to discuss the issue of legislative privilege. By 8/28/18, Defendants shall inform Plaintiffs whether they are withholding documents on the grounds of legislative privilege. By 8/30/18, the parties shall file statements of not more than three pages setting forth their position in regards to the issue of legislative privilege (or, alternatively, informing the Court that no such issues exist). If the issue of legislative privilege does require briefing, the following briefing schedule applies: Plaintiffs' motion to compel (9/7/18), Defendants' memorandum in opposition (9/14/18), Plaintiffs' reply (9/18/18). Alternative Service of Subpoena. Plaintiffs are authorized to serve a second subpoena on Tom Whatman by serving the subpoena, via certified mail, at the following locations: (1) the residence of Mr. Whatman's parents; (2) the other addresses believed to be Mr. Whatman's residence; and (3) Mr. Whatman's place of employment. The Court finds that service via certified mail at all of these locations reasonably insures Mr. Whatmans' actual receipt of the subpoena. ESI Protocol. The parties have jointly filed an agreed ESI Protocol Order. The Court will review the proposed order and act accordingly. Protective Order. The parties submitted a proposed stipulated protective order. (Doc. 47 -1). Paragraphs 2(h) and 6 allow certain filings to be made under seal. The parties shall forthwith amend these paragraphs to comply with binding Sixth Circuit precedent holding that parties cannot agree to file documents under seal, and requiring a party seeking to file under seal to establish compelling reasons for the seal that outweigh the public's interest in access to court records, and further establish that the seal is narrowly tailored to those compelling reasons. The parties shall forthwith email to chambers the amended Order. Pending Motions. Plaintiffs shall respond timely to Defendants' motion to dismiss (Doc. 46 ) and the intervenors' motion to intervene (Doc. 42 ), as soon as they are able.
