This case involves allegations regarding a 2019 Durham City Council member’s qualifications to run for election.

On March 18, 2020, a concerned voter living in Durham County filed this suit pro se in the Middle District of North Carolina against the North Carolina Board of Elections, Durham County Board of Elections, and a Councilmember of the Durham County Board of Elections. Plaintiff sued under N.C. Gen. Stat. § 163-182.10, which she alleged allowed her to raise concerns regarding election law violations. In particular, Plaintiff alleged concerns that defendant Caballero was not a naturalized citizen of the US and therefore was ineligible for public office. Plaintiff asserted that prior to the Durham City Council election Plaintiff filed a pre-election day protest raising concerns that the candidate for Durham’s City Council’s citizenship status potentially violated the U.S. and North Carolina Constitution. Plaintiff had filed an election protest with the Durham City Board of Elections, which was dismissed, and an appeal of the Board’s dismissal, which was also dismissed. Plaintiff filed a petition for judicial review with the North Carolina Superior Court of Wake County, which the court dismissed for lack of jurisdiction because the certificate of election had already been issued to the candidate at issue. 

Plaintiff filed an amended complaint on July 18, 2020. There were no differences between the original complaint and the amended complaint. 

 On August 4, 2020, Defendant Caballero filed her motion to dismiss, and Defendant Durham County Board of Elections filed its motion to dismiss on August 24, 2020. On August 31, 2020, Defendant North Carolina State Board of Elections filed its motion to dismiss. The defendants generally argued that Plaintiff lacked subject matter jurisdiction and failed to state a claim upon which relief can be granted. 

On December 29, 2020, the court granted the Defendants’ motions to dismiss and dismissed plaintiff’s complaint in its entirety. 

The plaintiff appealed on January 21, 2021 (docket no. 21-1095). The Court of Appeals for the Fourth Circuit affirmed the district court’s decision on July 23, 2021.

The case is now closed.
