This lawsuit was filed on June 10, 2021, by Latino and Latina voters against the state of Illinois, the Illinois State Board of Elections, the State Senate, and the State House of Representatives alleging that the new legislative districts under a redistricting plan adopted in June 2021 resulted in equal protection violations in the form of malapportionment. A similar lawsuit was also brought around the same time by an Illinois State Senator, McConchie v. Illinois State Board of Elections, and they were consolidated into this one case.  

The June redistricting map was not based on data from the Census Bureau, but rather a population estimate. In September 2021, after the Census Bureau released its statistics, a new redistricting plan was adopted by the Illinois legislature. Thereafter, the Illinois voters filed an amended complaint. On October 1, 2021, the voters filed their second amended complaint alleging that the new legislative districts under this redistricting plan resulted in equal protection violations in the form of malapportionment, racial gerrymandering, and voter dilution. 

On October 15, 2021, the Board of Elections filed a motion to dismiss for lack of jurisdiction based on Eleventh Amendment immunity for states and their agencies, but even if it could be sued, it claimed that it is not a person that can be sued and there were no claims that the Board of Elections or its members caused any of the claimed harm. They also argued that any claims remaining against the June redistricting plan were no longer valid because the plan had been replaced.

On October 19, 2021, the Court rejected the Board of Elections’ motion to dismiss and granted summary judgement in favor of the Illinois voters, finding that the June redistricting map was unconstitutional based on malapportionment. The Court held the redistricting map to be invalid and enjoined the Board of Elections from holding elections under the map. The Court then turned to the September redistricting map and required further briefing on the law and facts. 

Days before the Court ruled on the June map, the East St. Louis Branch NAACP and the United Congress of Community and Religious Organizations filed a third separate action challenging the September redistricting map as unconstitutional and violating the Voting Rights Act. United Congress of Comm, Et Al v. Illinois State Board of Elections, Et Al. The Court consolidated that lawsuit with the other two lawsuits and ordered briefing on their claims. 

On December 30, 2021, the Court rejected the arguments by all plaintiffs in the cases and upheld the September redistricting map. The Court noted that while the map was likely gerrymandered, it was not done so with race as a primary factor, and partisan gerrymandering is not by itself unconstitutional. 

Following the Court's December 30th ruling, the defendants filed motions for attorneys' fees related to the claims under 52 U.S.C. § 1988(b) and 52 U.S.C. § 10310(e). The parties met and reached a settlement agreement, but the contents of that agreement are not available to the public. The Notice of Settlement was filed on January 6, 2023.

All other expert deadlines and expert discovery are stayed until further order of the Court and will be discussed either with the three-judge panel on September 1, or with Magistrate Judge Jantz, or both. The pending dispositive motions [40, 55, 63] remain under advisement, though the panel observes that in the event that the General Assembly enacts an amended redistricting plan in next week's special session, the parties may need to consider whether to amend the pleadings and motions that currently are on file. The panel also reiterates the comments made on the record urging the General Assembly to take into account the views of the Plaintiffs in crafting any amended plan with the objective of presenting for the Court's consideration a plan that satisfies all constitutional and statutory obligations, not just those raised in the existing pleadings and motions. To the extent that an amended plan still raises viable legal challenges, the parties should expect to update their pleadings, motions, and expert work (including proposed revisions or alternatives to the map(s) under consideration) on a highly compressed schedule given the need for an expeditious conclusion to this litigation to accommodate the 2022 election calendar. As a housekeeping matter, the motions to dismiss the original (and now superseded complaint) [30, 33] are stricken as moot. In view of the foregoing, the status conference previously set for 8/24/2021 at 12:30 p.m. is stricken and reset to 9/1/2021 at 12:30 p.m. Information regarding the video link for the panel and counsel and the telephone link for members of the public and media will be provided in a separate minute order. Finally, the motion of Proposed Intervenor Defendant Angelica Guerrero-Cuellar to intervene 54 is taken under advisement; responses are due by 8/27/2021; reply is due by 8/31/2021.
