This case is a regarding a challenge to an Illinois redistricting map. October 15, 2021, the NAACP and others filed suit to challenge an Illinois redistricting map that was finalized in September 2021 as unconstitutional and violative of the Voters Rights Act. Plaintiffs brought this suit against the Illinois State Board of Election, its individual members, and individual members of the Illinois state House and Senate. It was consolidated into Contreras v. Illinois State Board of Elections, which also involved challenges to the redistricting map. Contreras also involved a previous map from June 2021, which was found to be unconstitutional. 

In its original complaint and briefing filed on November 18, 2021, the NAACP and its affiliates argued that the redistricting map resulted in equal protection violations in the form of malapportionment, racial gerrymandering, and voter dilution. The plaintiffs asked that the court declare the challenged districts unconstitutional and enjoin defendants from holding or enforcing any election under the map. District Judge Robert M. Dow presided over this case.

Following a trial before a three-judge panel, on December 30, 2021, the Court rejected the arguments by all plaintiffs in the cases and upheld the September redistricting map. The Court noted that while the map was likely gerrymandered, it was not done so with race as a primary factor, and partisan gerrymandering is not by itself unconstitutional.

As all concerned recognize, this litigation must proceed expeditiously and must conclude in time for the candidates to participate in, and the Board of Elections to administer, a primary election in 2022. The members of the panel (and the assigned Magistrate Judge) have endeavored to fairly balance the parties' needs to develop the facts, expert opinions, and legal briefs with the panel's need to render a reasoned decision in time for any appeals prior to the date by which nominating petitions must be circulated. We do that again today in considering the instant motion. As the Legislative Defendants point out, it is a considerable task to respond to the submissions of three sets of Plaintiffs. At the same time, the extension requested will push Plaintiffs to the cusp of the Thanksgiving holiday when their reply period starts. The panel will provide some relief to each side on these deadlines: Defendants' submissions are now due on 11/24/2021 no later than 2:00pm CST; Plaintiffs' reply submissions are now due on 12/1/2021 no later than 10:00am CST. The panel also advises that any potential trial/hearing will take place in-person in the James B. Parsons Ceremonial Courtroom, on the 25th Floor of the Dirksen Federal Building starting on Tuesday, December 7. Given the December 7 starting date, the parties will now be able to conduct depositions on December 1, 2, 3, and 6 if necessary. MINUTE entry before the Honorable Robert M. Dow, Jr: Telephone status hearing held on 12/3/2021. Panel advises parties that although no live testimony will be needed, this case is set for a hearing and oral argument to begin on 12/7/2021 at 9:00 a.m. in the James B. Parsons Ceremonial Courtroom (Courtroom 2525) on the 25th Floor of the Dirksen Federal Building. Social distancing protocols will be in effect as set out in the "Guidelines for Proceedings" filed on the docket after the hearing. Panel will advise on 12/6/2021 by minute order whether it has been able to secure (a) overflow courtroom with audio and/or video feed at the Dirksen Building and/or (b) audio link for interested observers to listen in to the proceedings remotely. Counsel wishing to test their computers should arrive in the Courtroom around 8:30 a.m. on 12/7/2021. Hearing/argument will conclude no later than 4:00 p.m. on 12/7/2021, but may resume at 9:00 a.m. on 12/8/2021 if necessary. Parties were advised of further details on the format of the hearing/argument, including that (a) the Panel will open the proceedings on 12/7 with some general observations and/or questions that they would like counsel to address in their remarks; (b) counsel for each set of Plaintiffs, proceeding in order of case number with lowest case number (21-cv-3091) going first, will be given 20 minutes of initial argument time; (c) Legislative Defendants will be given 60 minutes to respond to the presentations by counsel for Plaintiffs; (d) Panel will ask additional questions after opening arguments; (e) Plaintiffs' counsel will be given 20 minutes per side in the same order as before for rebuttal, (f) counsel for the Legislative Defendants will be given 60 minutes for sur-rebuttal. If at any time counsel for the Board of Elections Defendants wish to be heard on any matter, they may make a request of the Panel and will be recognized. If any counsel wish to cite to depositions taken after the filing of the 12/1 briefs, they should reference the deposition during the argument and then provide the relevant pages of the transcripts to the Panel as soon as possible after the hearings conclude. Sur-reply briefs strictly confined to new material raised in reply briefs, depositions taken after 12/1, and any additional briefing requested by the Panel will be due by 12/10/2021; sur-sur-replies strictly limited to those same topics will be due by 12/14/2021.
