This case was brought by electors of ten different states seeking to investigate whether all candidates for 2008 election of the President and Vice-President of the United States qualified as “Natural Born” citizens under Article II of the Constitution in the 2008 election.   On November 3, 2008, the plaintiffs sued the Mississippi Secretary of State in the United States District Court for the Southern District of Mississippi. This case was brought by electors of ten different states seeking to investigate whether all candidates for 2008 election of the President and Vice-President of the United States qualified as “Natural Born” citizens under Article II of the Constitution in the 2008 election.  

On November 3, 2008, the plaintiffs sued the Mississippi Secretary of State in the United States District Court for the Southern District of Mississippi. Represented by private counsel, the plaintiffs asked for a declaratory judgment that the Secretary of State, or another officer to whom is delegated the responsibility for the integrity of the ballot in that state, had to verify the qualifications of all candidates for the offices of President and Vice-President of the United States, including Barack Obama and John McCain, as “Natural Born” citizens under Article II of the Constitution of the United States. To that end, the plaintiffs requested expedited discovery enabling the Mississippi Secretary of State to obtain evidence about the qualifications at issue, and they further requested that the Mississippi Secretary of State of communicate such findings to the Secretaries of State in all other states.  The case was assigned to Judge Keith Starrett. 

On November 12, 2008, the plaintiffs filed an emergency motion to expedite discovery, arguing that it was necessary given the deadline for the Secretaries of State to certify the election results was December 9. The Court denied this motion on November 18, 2008. The Court was not convinced that the electors had made the requisite showing for emergency discovery because, it found, any questions regarding the citizenship of candidates could have been raised months ago. 

On December 16, 2008, the plaintiffs moved the Court for a voluntary dismissal of the action, which the Court granted on December 17, 2008. The case was terminated that day.
