This is a case alleging racial gerrymandering in North Carolina. 

On August 22, 2013 Wake County Board of Elections in Wake County, North Carolina mapped a new plan for their voting districts, called the Session Law 2013-110. This redistricting plan was intended to change the voting districts composition for the Wake County Board of Education. 

On August 23, 2013, Plaintiffs, Wake County registered voters, submitted a complaint to the court regarding this redistricting plan. Plaintiffs challenged the plan under the equal protection clause of the Fourteenth Amendment to the US Constitution and under a similar provision in the North Carolina State Constitution for violating the one person, one vote principle and for being racial gerrymandering. They also submitted a challenge under Raleigh Wake Citizens Association v. Wake County Board of Elections (No. 5:13-CV-607-D) which challenged an identical redistricting plan to be used for the Wake County Board of Commissioners. The two actions were consolidated on October 1, 2015. 

After a three (3) day trial in December 2015, the District Court for the Eastern District of North Carolina found for Defendant and dismissed all Plaintiffs' claims. The Plaintiffs appealed in March, 2016 (Docket No. 16-1271). On appeal, the Fourth Circuit affirmed the district court's judgment as to the Plaintiffs' racial gerrymandering claim, but reversed as to all the one person, one vote claims. 

On September 29, 2017, the Court ordered permanent declaratory and injunctive relief enjoining the use of the unconstitutional redistricting plan in Session Law 2013-110 (the board of education) and Session Law 2015-4 (the board of commissioners) in any elections going forward. The population deviations in the enjoined redistricting plan violated the equal protection clauses of the Fourteenth Amendment to the US Constitution and Article 1, Section 19 of the North Carolina constitution. The Defendant was to use the 2011 redistricting plan as a court-ordered interim solution and was ordered by the Court to enact an appropriate and constitutional system for electing the Wake County School Board and Wake County Board of Commissioners upon returning in 2017.

The case is now closed.
