On March 14, 2016, four individual plaintiffs filed a suit against the Texas Secretary of State and the Director of the Texas Department of Public Safety (“DPS”), seeking declaratory and injunctive relief to redress defendants’ alleged systemic and ongoing violations of the “motor voter” provisions of the National Voter Registration Act of 1993 (“NVRA”). The plaintiffs also alleged that the defendants’ conduct violated the Equal Protection Clause of the Fourteenth Amendment due to alleged disparate treatment and arbitrary restrictions on the right to vote.  

The main purpose of the NVRA is to increase the registration of eligible voters. The NVRA requires eligible voters to be registered to vote “simultaneously” with the submission of any driver’s license application, renewal, or change-of-address form.  

The plaintiffs claimed that unlike defendants’ simultaneous voter registration services for license renewal or address update applications submitted in-person at a DPS office, the defendants did not provide for simultaneous voter registration at any point during the online license renewal or address update process. Instead, the voters were directed to another website where they were notified to download or request a physical voter registration form. In order to register to vote, the voter would have to complete a separate voter registration form and then mail the form to the appropriate county registrar before the voter registration deadline. 

Represented by private attorneys and the Texas Civil Rights Project, the plaintiffs sought declaratory relief under 28 U.S.C. § 2201, and injunctive relief. Specifically, they sought to enjoin the defendants (including their agents and successors in office, and all individuals working in concert with them) from implementing practices and procedures that violate the NVRA. Further, the plaintiffs requested the court to direct defendants to take appropriate measures necessary to remedy the harm caused by their noncompliance. The case was filed in the United States District Court for the Western District of Texas, San Antonio Division and assigned to Judge Orlando Garcia.

On May 10, 2018, the District Court granted plaintiffs’ motion for summary judgment. The District Court stated that the requirements in the NVRA clearly apply to online transactions (e.g., electronic, remote, or internet transactions). The District Court further stated that numerous courts have determined that the NVRA requirements applies to online or remote transactions in the same manner it applies to in-person and mail transactions. The District Court reasoned that the NVRA requires DPS to provide a simultaneous application, not a simultaneous opportunity to undergo a second duplicate application process. The District Court determined that DPS is legally obligated to provide a simultaneous voter registration application with every transaction. The District Court found that the defendants violated the NVRA and the Equal Protection Clause. Therefore, the District Court entered a final judgment granting plaintiffs declaratory and injunctive relief. The District Court permanently enjoined defendants from continuing to violate the NVRA and Equal Protection Clause, and ordered them to establish procedures that treat each online driver's license renewal or change-of-address application as a simultaneous application for voter registration, which must then be submitted to the Secretary of State.

On November 13, 2019, the defendants appealed to the United States Court of Appeals for the Fifth Circuit. The Fifth Circuit held that the plaintiffs did not have standing to seek declaratory and injunctive relief because they had not shown a continuing or threatened future injury to their right to vote. Therefore, the Fifth Circuit reversed the judgment of the District Court and vacated the District Court’s injunction. The case was remanded to the District Court with instructions to dismiss plaintiffs’ claims for lack of standing. 

On January 17, 2020, the plaintiffs filed an emergency application for preliminary injunction and request for hearing. The District Court stated that although the Fifth Circuit found that the plaintiffs had not proven they would likely sustain another injury in the future, the injury has happened again. The plaintiffs visited the DPS website to change their address and were not offered a simultaneous application for voter registration. If these registrations were not updated before February 3, 2020, the plaintiffs would not have been able to vote in the March 2020 primary election. The District Court stated that it had revisited the issue and reached the same conclusion as it did in May 2018. The District Court found that the defendants violated the NVRA because plaintiffs were denied the right to simultaneously update their voter registration when they updated their address on the DPS website. The District Court reasoned that the provisions of the NVRA did not incorporate Texas election law and was not subject to it, Texas election law must yield to the NVRA, and there was nothing in either the NVRA or state law that prevented the use of electronic signatures in online driver's license-voter registration transactions. Therefore, the District Court determined there was a substantial likelihood that the plaintiffs would succeed on the merits of their NVRA claims. The District Court also determined that the plaintiffs had met the other elements of the preliminary injunction and granted partial injunctive relief. The District Court ordered that the defendants must immediately register the plaintiffs to vote and must confirm that the plaintiffs are registered to vote before the deadline to register to vote so they may participate in the upcoming primary elections. 

On August 28, 2020, the District Court granted the remainder of the request for preliminary injunctive relief. The District Court ordered the defendants to immediately take all the remaining steps necessary to come into compliance with NVRA by establishing a DPS System that treats each online driver's license renewal or change-of-address application as a simultaneous application for voter registration. The Defendants were ordered to complete this process and make the DPS system fully operable for public use by September 23, 2020.
