This is a case challenging the higher education provisions in Florida’s “Stop WOKE Act.” On September 6, 2022, the plaintiffs––an undergraduate student, a professor, and a student organization at the University of South Florida––filed this suit in the U.S. District Court for the Northern District of Florida against the state, the Florida State Board of Education, the Florida Board of Governors of the State University System, and the University of South Florida Board of Trustees. The plaintiffs alleged that the Stop WOKE Act infringed on their First Amendment right to speech relating to topics of public concern, which included topics covered by the Act like race and sex. The plaintiffs further argued that the Act constituted viewpoint discrimination because it prohibited individuals from “endorsing” specific views and that the Act infringed on students’ rights to receive information and ideas under the First Amendment. Additionally, the alleged that the statute was unconstitutionally vague in violation of the Due Process Clause of the Fourteenth Amendment. Finally,the plaintiffs brought a claim under Florida’s Campus Free Expression Act, which they claimed prohibits a public university from denying students “access to, or observation of, ideas and opinions that they may find uncomfortable, unwelcome, disagreeable, or offensive.” The plaintiffs requested preliminary and permanent injunctive relief including an order enjoining the defendants from enforcing the Stop WOKE Act. The plaintiffs also requested declaratory relief advising them of the constitutional status of the Act under the First and Fourteenth Amendments and under the Campus Free Expression Act. 

On September 15, 2022, the plaintiffs filed a motion for a preliminary injunction. Reiterating the reasoning in their complaint, the plaintiffs argued that they were likely to succeed on the merits and would suffer irreparable harm if a preliminary injunction was not granted. On November 17, 2022, the court granted in part and denied in part the plaintiffs’ motion. In the opinion, which referred to the Stop WOKE Act as “positively dystopian,” Judge Walker found that five of the eight prohibited concepts were topics that the plaintiffs were planning to teach or learn in upcoming classes. Because the act would prevent them from freely exchanging these ideas (which Judge Walker agreed constituted an irreparable injury), the defendants were enjoined from enforcing the Stop WOKE Act against them.  

On September 30, 2022, the defendants filed a motion to dismiss. The court granted in part this motion on November 30, 2022, reasoning that the Board of Trustees as an entity was immune to federal suit because of the Eleventh Amendment as to all claims. Moreover, the court determined that all defendants were immune from federal suit as to the Campus Free Expression Act, which was a state law. However, the court denied the defendants' motion to dismiss all other claims.

On November 29, 2022, the defendants appealed the district court's issuance of a preliminary injunction to the U.S. Court of Appeals for the Eleventh Circuit. The parties have stayed proceedings in the district court pending the Eleventh Circuit's resolution of the appeal, and this case is ongoing.
