This putative class action lawsuit was filed on December 10, 2020, in the U.S. District Court for the Southern District of Indiana, on behalf of Black student-athletes at HBCUs. The plaintiffs alleged that the National Collegiate Athletic Association (NCAA) engaged in discriminatory practices through the use of its Academic Performance Program in violation of 42 U.S.C. § 1981, 42 U.S.C. § 1985, and the District of Columbia Human Rights Act. Represented by private counsel, the plaintiffs sought injunctive relief as well as compensatory and punitive damages. Judge Richard L. Young was assigned to the case.

NCAA’s Academic Performance Program imposed penalties on teams if their players did not do well enough academically, including potentially preventing the team from playing in the postseason. However, the plaintiff alleged that the metrics the NCAA had chosen for the program were discriminatory and caused teams at HBCUs to be disproportionately penalized. The plaintiff alleged that this violated 42 U.S.C. § 1981’s ban on racial discrimination in contracting and 42 U.S.C. § 1985’s ban on conspiring to deprive people of their civil rights.

The NCAA moved to dismiss the action on February 8, 2021 for failure to state a claim and lack of standing. The court denied the motion on September 13, 2021, with respect to two plaintiffs. Judge Young determined that these plaintiffs had sufficiently alleged plausible injury on the basis that their schools were banned from postseason play based on an academic formula that the NCAA knew would discriminate against Black student-athletes at HBCUs. Judge Young granted the motion to dismiss for claims brought by one plaintiff for lack of standing, since her team had not been banned yet from postseason play, and further granted the motion to remove the NCAA’s Board of Directors and NCAA’s Division I Board of Directors as defendants because they were unincorporated associations and not suable entities under Indiana law. 

The parties then began to engage in highly contentious discovery. On June 16, 2022, Magistrate Judge Mark J. Dinsmore denied a motion to disqualify plaintiff’s counsel after a staff attorney for the plaintiff’s firm was found to be moonlighting as a document reviewer for the defendant as well. Judge Dinsmore determined that the defendant failed to engage in adequate due diligence which would have prevented hiring this attorney as a document reviewer. 2022 WL 2176334.

Magistrate Judge Dinsmore intervened in discovery again on June 23, 2022, to grant in part and deny in part plaintiff’s motion to compel discovery. Plaintiff argued that he should receive NCAA documents going back to the 1960s, but Magistrate Judge Dinsmore held that this was a disproportionate request and limited discovery to going back to January 1, 1998. 2022 WL 2292833. On February 27, 2023, plaintiff moved for attorneys’ fees for the motion to compel.

The following month, on March 24, plaintiff moved to certify two classes: an Injunctive Relief Class of Black student-athletes who played on Division I HBCU teams since December 2020, and a Liability Class of Black student-athletes who played on Division I HBCU teams that were banned from the postseason between 2010 and the date of class certification. 

On the same day, plaintiff also moved to amend his complaint with a few minor changes. A month later, on April 21, Magistrate Judge Dinsmore granted the motion in part, and plaintiff filed an amended complaint five days later.

Later that year, on June 16, the NCAA moved for summary judgment. The following month, on July 14, plaintiff also moved for partial summary judgment.

On August 27, 2023, a current student-athlete moved to intervene in this case as a plaintiff and be appointed as the class representative of the Injunctive Relief Class. On September 5, 2023, the court denied the motion to intervene, 2023 WL 5722677, and the plaintiff pursued a separate case (McKinney v. National Collegiate Athletic Association).

On October 19, 2023, Judge Young granted the NCAA’s motion for summary judgment. Judge Young held that the named plaintiff lacked standing to seek injunctive relief because he had already graduated from college, and that his claims under §§ 1981 and 1985 were barred by the respective statutes of limitations. Judge Young also denied the motion for class certification, holding that the named plaintiff could not represent the Liability Class due to the statute of limitations, and that there was no representative for the Injunctive Relief Class because the proposed representative had been dismissed back in 2021.

As of November 11, 2023, the case was ongoing pending the resolution of plaintiff’s motion for attorneys’ fees.
