Under Railroad Comm'n of Texas v. Pullman Co., 312 U.S. 496, 500 (1941) and its progeny, "federal courts should abstain when litigants challenge state actions on federal constitutional grounds in federal court and the answer to an unsettled question of state law might eliminate the need to decide the federal constitutional question or materially alter the way the federal court would view that question." 17A Moore's Federal Practice - Civil §122.20. As the parties may be aware, federal courts are permitted to raise the issue of abstention sua sponte. See Catlin v. Ambach, 820 F.2d 588, 591 (2d Cir. 1987). Each party is directed to file submissions no longer than ten (10) pages on February 3, 2023. Each party may also file a rebuttal submission no longer than five (5) pages on February 10, 2023. See ECF No. 72. We also take this occasion to bring Judge Friendly's opinion in Galvan v. Levine, to the parties' attention, which more artfully states one of the points the Court was trying to make in its April 3, 2023 call with the parties: [I]nsofar as the relief sought is prohibitory, an action seeking declaratory or injunctive relief against state officials on the ground of unconstitutionality of a statute or administrative practice is the archetype of one where class action designation is largely a formality, at least for the plaintiffs. 490 F.2d 1255, 1261 (2d Cir. 1973); see also Davis v.
