Case Summary

This is a case about whether a private college's investigation of alleged sexual misconduct was unfair and biased. A former male student at Stonehill College, a private Catholic college in Easton, Massachusetts, was expelled from the school in February 2018 after the school's Title IX investigators found that it was "more likely than not" that he had engaged in "nonconsensual intercourse" with another female student in November 2017. This is a case about whether a private college's investigation of alleged sexual misconduct was unfair and biased. A former male student at Stonehill College, a private Catholic college in Easton, Massachusetts, was expelled from the school in February 2018 after the school's Title IX investigators found that it was "more likely than not" that he had engaged in "nonconsensual intercourse" with another female student in November 2017. On March 9, 2020, the plaintiff filed this lawsuit in the U.S. District Court for the District of Massachusetts. The plaintiff sued Stonehill College under Title IX (20 U.S.C. § 1981, et seq.) and Massachusetts state law. The case was assigned to Judge Leo T. Sorokin. Judge Sorokin granted the plaintiff’s July 30, 2020 motion to file an amended complaint, which was then subsequently filed on August 5. 

The amended complaint asserted, inter alia, sex discrimination in violation of Title IX, breach of contract, negligence, and defamation. The core claim in the plaintiff’s suit was that there were multiple procedural errors in the Title IX investigation conducted by the defendant that denied the plaintiff of the fair and thorough process promised by the school’s sexual misconduct policy. Represented by private counsel, the plaintiff sought a declaratory judgment stating that the defendant's investigation violated various rights, the finding of responsibility against him was illegal, and the defendant’s policies violated Title IX. The plaintiff also sought a permanent injunction compelling Stonehill to vacate its findings and remove all negative references from Doe's record, in addition to the payment of attorney's fees.

The defendant moved to dismiss the case on August 10, 2020. On February 3, 2021, Judge Sorokin granted the defendant's motion on all counts. First, he held that the plaintiff’s claims failed to plausibly allege a Title IX violation for four main reasons: (1) the defendant, as a private college, was not statutorily required to conduct a live hearing with cross-examination for disciplinary proceedings involving claims of sexual misconduct, (2) plaintiff failed to allege any facts demonstrating that the proceeding was initiated against him because of his gender, (3) plaintiff had no plausible allegations that any procedural or factual deficiencies in his proceeding were motivated by gender bias, and (4) plaintiff failed to properly allege claims that cast articulable doubt on the accuracy of the school’s outcome. 2021 WL 706228.

Next, Judge Sorokin dismissed the breach of contract claim for two main reasons: (1) the plaintiff did not allege that the defendant failed to meet plaintiff’s “reasonable expectations” based on the school’s sexual misconduct policy, and (2) the defendant’s failure to provide a live hearing with cross-examination did not violate plaintiff’s right to “basic fairness” under Massachusetts state contract law. Finally, Judge Sorkin found that the plaintiff failed to sufficiently allege negligence and defamation by the defendant. 2021 WL 706228.

On March 19, 2021, the plaintiff appealed the dismissal to the First Circuit. On December 14, 2022, the First Circuit (Judges Gustavo Gelpí, Kermit Lipez, and Jeffrey R. Howard) reversed Judge Sorkokin’s dismissal of the breach of contract claim but otherwise affirmed the decision of the district court for all other counts. In an opinion authored by Judge Lipez, the First Circuit concluded that the plaintiff plausibly alleged that the defendant breached both his “reasonable expectations” of the school’s sexual misconduct policy and Massachusetts’ right to “basic fairness” for four reasons: the defendant (1) denied plaintiff the opportunity to review all relevant facts before the final investigative report was sent to the Associate Vice President for Student Affairs, (2) declined to provide plaintiff advance notice of the sexual assault victim’s second interview, (3) failed to perform a “fair and thorough investigation” through flaws in the investigators’ gathering and presentation of the facts, and (4) did not ensure that the ultimate decisionmakers independently reviewed the facts to assess whether the plaintiff “more likely than not” engaged in nonconsensual intercourse with the victim. The First Circuit reversed the dismissal of the counts seeking a declaratory judgment and permanent injunction and remanded the case to the district court for further proceedings on the plausible contractual breaches. 55 F.4th 302.

On June 21, 2023, the parties entered into a settlement agreement. The settlement was private. On the same date, Judge Sorkin ordered that the case be dismissed, provided that neither party reopened the lawsuit within 30 days if settlement was not consummated. Neither party reopened the action within 30 days.

The case is now closed.
