This is a class action disability rights lawsuit concerning access to the Golden Gate National Recreation Area (GGNRA) for individuals with mobility and vision disabilities. The GGNRA is the largest national park unit in an urban area and includes lands and coastline across several counties in the San Francisco Bay Area. As an entity within the U.S. Department of Interior (DOI), GGNRA was required in 1988 to prepare transition plans to bring their facilities into compliance with Section 504 of the Rehabilitation Act of 1973 (29 U.S.C. § 794), which prohibits discrimination against any qualified individual with a disability by any program receiving federal funding. GGNRA purportedly developed a plan to identify accessibility barriers and solutions, however, in 2000, the Accessibility Coordinator for GGNRA found that the 1988 transition plan was out of date. An updated transition plan was produced later that year but did not address access to trails or beaches. According to plaintiffs’ initial complaint, this lawsuit to bring GGNRA into compliance was only filed after over a year of efforts to reach an agreement to update the 2000 transition plan out of court. 

On January 31, 2008, three individuals with mobility and vision disabilities, represented by Disability Rights Advocates (DRA), filed suit in the U.S. District Court for the Northern District of California. Defendants included the GGNRA, the National Park Service, and the General Superintendent of the GGNRA and Director of the National Park Service, both in their official capacities. Plaintiffs sued under Section 504, seeking declaratory and injunctive relief (in the form of making GGNRA facilities accessible), and attorneys’ fees. Plaintiffs asserted that the defendants discriminated against people with mobility and vision disabilities in various ways.  First, they alleged that GGNRA failed to  remove or minimize physical barriers (like parking lot curbs), preventing access to trails for people with mobility disabilities. They further asserted that GGNRA failed to provide signage, exhibits, and other displays in information systems accessible to people with visual impairments. Finally, plaintiffs alleged that GGNRA did not provide information regarding accessibility on their website in an accessible form, nor did they provide summaries of accessible features (ex: information assessing trail difficulty) at each park unit. The case was assigned to Magistrate Judge Elizabeth D. Laporte. 

Shortly after the initial complaint was filed, plaintiffs submitted an amended class action complaint on February 7, 2008, seeking to represent a class of all individuals with mobility and vision disabilities who use or will use GGNRA facilities in their pursuit of injunctive and declaratory relief. Plaintiffs later filed a second amended complaint on April 25, 2008, which included more details on plaintiffs’ experiences at GGNRA facilities. Plaintiffs also later added organizational plaintiff California Council of the Blind (CCB) in their third amended complaint.

On April 28, 2008, the court issued an order referring the case to Magistrate Judge Edward M. Chen for a settlement conference scheduled for July 18, 2008. The parties did not settle at the July 18 conference and a second settlement conference was promptly scheduled. Though the second conference was also ultimately unsuccessful, the parties made progress towards a final settlement and began drafting the first two of six phases of alterations to make GGNRA facilities accessible. The court granted the parties a stay of litigation on August 11, 2008, ordering them to file a joint status report in early 2009. The January 5, 2009 status report noted that discussions continued to be productive and the parties sought to continue the stay of litigation. 

Several months later, in August 2010, the parties reported that the settlement discussions had reached an impasse. The court lifted the stay on August 6, 2010. On February 8, 2011, during a period of extended discovery, plaintiffs filed a motion for certification of the class initially sought in their February 7, 2008 class action complaint. The court declined to rule on class certification until after the U.S. Supreme Court issued its order in Wal-Mart Store v. Dukes

The court granted class certification on August 30, 2011. The court found that plaintiffs satisfied the narrower commonality requirement established by Wal-Mart because the evidence showed common policies and practices across GGNRA facilities resulting in barriers for a closely aligned class, even though not all class members shared the same kind or degree of accessibility barrier. Plaintiffs also satisfied the Wal-Mart commonality requirement because a sufficiently specific injunction to resolve the proposed class’s claims could be formulated. 279 F.R.D. 501.

Shortly thereafter, GGNRA sought reconsideration of the  class certification decision in the district court on the basis of intervening decisions by the U.S. Court of Appeals for the Ninth Circuit; the district court granted and denied in part the motion for reconsideration on November 15, 2011. The court denied GGNRA’s claim that the two Ninth Circuit decisions necessitated a more stringent application of the Wal-Mart class certification analysis but, out of an abundance of caution, required plaintiffs to amend their complaint to allege the challenged deficient policies and procedures with greater specificity. 866 F.Supp.2d 1129. Plaintiffs filed their fourth amended class action complaint on November 29, 2011. That same day, GGNRA filed a petition to the Ninth Circuit seeking interlocutory appeal of the class certification and a stay pending the appeal, which was granted by the district court. 2011 WL 6934433. GGNRA’s petition for interlocutory appeal was unsuccessful. The Ninth Circuit denied the petition to appeal on February 21, 2012. Thereafter, on April 6, 2012, GGNRA sought to dismiss plaintiffs’ amended complaint for lack of standing. On July 3, 2012, the district court denied in part and granted in part the motion to dismiss by limiting plaintiffs’ standing to the geographic areas of GGNRA that they had either visited or were demonstrably deterred from visiting. 2012 WL 13140460.

On August 14, 2012, plaintiffs filed a motion for summary judgment, and on September 21, 2012,  defendants filed a cross-motion for summary judgment. GGNRA contended that plaintiffs lacked standing to assert Section 504 and broad injunctive relief claims and that they had made substantial efforts to improve accessibility within their budgetary constraints while plaintiffs argued that the court should find as a matter of law that they had standing to seek broad injunctive relief on all access barriers on behalf of the certified class.  The court issued an order on February 20, 2013, granting in part and denying in part the cross-motions, finding that plaintiffs did have standing to bring Section 504 claims against some but not all of the challenged GGNRA barriers. Specifically, the court held that plaintiffs did not have standing to challenge certain third-party programs or the GGNRA website, which no plaintiff claimed to have tried to access before the complaint was filed. 2013 WL 12386845. GGNRA filed a motion for reconsideration on March 8, 2013, but, thereafter, the parties resumed settlement discussions. 

The parties submitted a settlement agreement to the court on February 3, 2014. Terms of the settlement agreement included wheelchair access to several popular trails and beaches; braille, audio, and tactile orientation signs, guides, and maps for visitors with vision impairments; accessibility training for park staff; and a dedicated maintenance fund to ensure accessibility of new construction at GGNRA facilities. GGNRA agreed to allocate at least $3,000,000 towards accessibility projects and a further $350,000 on maintenance of accessibility features. GGNRA also committed to paying $3,430,000 (of which plaintiffs set aside $250,000 for monitoring GGNRA’s implementation) to satisfy any and all claims for fees, expenses, and costs. The agreement stipulated a seven-year period to complete the terms. The settlement agreement pertained to both this case and Gray v. Golden Gate National Recreation Area (No. 3:14-cv-00511), which was filed in 2013 alleging substantively the same claims. The two cases were officially consolidated for settlement purposes on February 5, 2014. 

On February 5, 2014, the case was stayed per the terms of the settlement agreement, which provided for seven years of monitoring.
