This is a case about voting rights in Arkansas in light of the 2021 reapportionment plan for the Arkansas House of Representatives (“the Board Plan”). On December 29, 2021, the Arkansas State Conference NAACP (“the Arkansas NAACP”) and the Arkansas Public Policy Panel (“the Panel”) filed this lawsuit in the U.S. District Court for the Eastern District of Arkansas. The plaintiffs were represented by the ACLU (Voting Rights Project) and private counsel. The defendants were the State of Arkansas, the Arkansas Board of Apportionment (“the Board”), and the Board’s three members (the Arkansas Governor, Attorney General, and Secretary of State) in their official capacities both as their respective state positions and as Board members. The plaintiffs sued under Section 2 of the Voting Rights Act (52 U.S.C. § 10301), seeking declaratory and injunctive relief (in the form of complying with Section 2 of the Voting Rights Act), and attorneys’ fees. The plaintiffs asserted that the Board Plan diluted Black voting strength in violation of Section 2 of the Voting Rights Act. Specifically, plaintiffs challenged the results of the Board Plan (rather than alleging intentional or purposeful discrimination by the defendants). They alleged that the Board Plan contained just eleven majority-Black House districts even though more than sixteen percent of Arkansas’ population is Black, and it would be possible to draw sixteen (out of 100) geographically compact, majority-Black House districts. The case was assigned to Judge Lee P. Rudofsky. 

On the same day as the complaint, on December 29, 2021, the plaintiffs filed a motion for preliminary injunction. The next day, on December 30, 2021, Judge Rudofsky granted in part and denied in part the defendants’ request for an extension. In deciding this motion, Judge Rudofsky balanced the need for expedited consideration of plaintiffs’ motion for preliminary injunction in view of the looming 2022 election and the fact intensive nature of this case. 

Shortly after the complaint was filed, the plaintiffs filed a motion for recusal on December 31, 2021. The motion questioned Judge Rudofsky’s impartiality with respect to two of the defendants (the Attorney General and the Governor). As the basis for this challenge, the plaintiffs asserted that prior to Judge Rudofsky’s appointment to the bench, he made contributions to the Attorney General’s and Governor’s campaigns, held a fundraiser for the Attorney General, and had been appointed to the role of Arkansas Solicitor General by the Attorney General. Because the Attorney General and the Governor were likely to be called as witnesses, the plaintiffs argued a reasonable member of the public could doubt Judge Rudofsky’s impartiality. On January 5, 2022, Judge Rudofsky denied the plaintiffs’ motion for recusal, finding the allegations based on the Governor borderline frivolous (a $500 contribution four years prior to this case) and the allegations based on the Attorney General insufficient (non-substantive communication and prevalence of prior professional relationships between judges and government officials). 

The preliminary injunction hearing began on February 1, 2022, and ended on February 8, 2022. In opposition to the plaintiffs’ motion, the defendants argued that replacing the Board Plan with a new districting plan for the 2022 election would cause catastrophic confusion and administrative errors. The plaintiffs relied heavily on Milligan v. Merrill, in which a federal court in Alabama granted similar preliminary relief. However, on February 7, 2022, the U.S. Supreme Court stayed the preliminary injunction that had been granted in Alabama. Milligan v. Merrill, 142 S. Ct. 879 (2022). In response, the plaintiffs for this case argued that there were meaningful distinctions between this case and the case in Alabama. The plaintiffs also adjusted their request for relief, which entailed allowing the 2022 elections to take place using the Board Plan but ordering a special election for all Arkansas House districts in 2023 using a new map. 

Despite noting that “there [wa]s a strong merits case that at least some of the challenged districts in the Board Plan [we]re unlawful under § 2 of the Voting Rights Act,” Judge Rudofsky issued an order on the preliminary injunction on February 17, 2022, dismissing this case without reaching the merits. As an initial threshold matter, Judge Rudofsky began with the issue of standing. Because the plaintiffs were not individual voters, Judge Rudofsky applied the Hunt test to determine whether the plaintiffs had “associational standing.” The Hunt test required the plaintiffs to allege sufficient facts that, if proven, would establish that (1) the organization’s members have standing to sue in their own right, (2) the interests asserted in the lawsuit are “germane” to the organization’s purpose, and (3) the lawsuit does not require the individual members to participate in the litigation. Hunt v. Wash. State Apple Advert. Comm’n, 432 U.S. 333, 343 (1977). Additionally, Supreme Court precedent required that redistricting lawsuits proceed district-by-district. Concerned that the complaint was too vague and general, Judge Rudofsky requested more information (whether the plaintiffs had members in all of the Board Plan districts that allegedly diluted Black voting strength). After reviewing the plaintiffs’ supplemental declarations, Judge Rudofsky concluded that the Panel had standing, and did not reach the question of whether the Arkansas NAACP had standing. 

Judge Rudofsky then addressed whether the court had subject-matter jurisdiction. After analyzing the text and structure of the Voting Rights Act and precedent, Judge Rudofsky concluded that there is no explicit private right of action, and declined to imply one in its absence. As a procedural argument, the plaintiffs argued that the court should ignore the private-right-of-action question entirely because the defendants did not raise it in their response. This argument attempted to transform the existence of a private right of action from a jurisdictional question into a merits question. While noting that two Supreme Court cases (Verizon Md., Inc. v. Pub. Serv. Comm’n of Md., 535 U.S. 635 (2002), and Steel Co. v. Citizens for a Better Environment, 523 U.S. 83 (1998)) seemed to agree with the plaintiffs that a cause of action does not go to a court’s subject-matter jurisdiction, Judge Rudofsky was bound by an Eighth Circuit decision (Cross v. Fox, 23 F.4th 797 (8th Cir. 2022)), which clearly held that the existence of a private right of action is a jurisdictional question. Accordingly, Judge Rudofsky found that the court did not have subject-matter jurisdiction. 

On February 17, 2022, Judge Rudofsky issued the order finding that only the Attorney General of the United States could bring this case. Judge Rudofsky indicated that he would give the United States five calendar days to join the case as a plaintiff. On February 22, 2022, the United States submitted a notice with the position that private parties do have the ability to enforce Section 2 of the Voting Rights Act through a private right of action. Accordingly, the United States indicated that they would not join the case. In response, Judge Rudofsky dismissed the case without prejudice. 

On February 23, 2022, the plaintiffs filed a notice of appeal to the U.S. Court of Appeals for the Eighth Circuit, challenging the holding that only the Attorney General of the United States could enforce Section 2 of the Voting Rights Act (No. 22-1395). On January 11, 2023, Judges Lavenski R. Smith, Raymond W. Gruender, and David R. Stras heard oral arguments. 

On November 20, 2023, the Eighth Circuit issued its opinion, affirming Judge Rudofsky's conclusion that only the Attorney General could bring this case. The Eighth Circuit concluded that neither the text nor the structure of the Voting Rights Act provided a private right of action, so the private plaintiffs in this case lacked standing. The court thus modified the district court's dismissal to be with prejudice.

The plaintiffs have until February 18, 2024 to petition the Supreme Court for a writ of certiorari, and it is widely predicted that they will do so.

Two members of my household (one is vaccinated and boosted; the other is not eligible for the vaccine) tested positive for Covid-19 in the last several days. Then, on Sunday, I developed symptoms consistent with Covid-19. Out of concern for the safety of Court staff, litigants, and attorneys, I have chosen to quarantine until I receive a PCR result. Given the current overload on the testing system, I am not sure when I will get that result. Accordingly, the in-person PI hearing will need to be rescheduled to start the first part of the first week of February. My courtroom deputy will reach out to the parties to work on scheduling.
