This case regards Texas, Louisiana, and Mississippi’s opposition to limitations on a state’s discretionary use of funds appropriated to the states as part of the American Rescue Plan. On May 3, 2021, three states filed this suit in the U.S. District Court for the Northern District of Texas, with Judge Matthew J. Kacsmaryk presiding. Each state’s attorney general sued the U.S. Department of Treasury for violating their sovereign tax authority by usurping their ability to decide how to tax. Represented by each of their attorneys and solicitors general, the states asked the court to enjoin the Tax Mandate in §9901 of the American Rescue Plan, which prevented states from using the funds allocated by the ARP to decrease net tax revenues in a given year and make up for the shortfall with the money distributed by the ARP. The states argue that the prohibition on using the funds provided by the American Rescue Plan to affect their tax decisions in any way is unconstitutional. 

The defendants moved to dismiss for lack of subject matter jurisdiction and failure to state a claim upon which relief may be granted on the basis that the provision at issue does not usurp a state’s sovereign taxing authority and that the states have not yet engaged in any behavior which is violative of the provision. The court never addressed the motion as the plaintiff’s motion for partial summary judgment in response was granted, mooting the issues raised by the motion to dismiss.

The plaintiff's motion for partial summary judgment was granted in part while the defendant's motion for summary judgment was denied. The plaintiff’s motion argued that Congress’s ARP offer in exchange for accepting the Tax Mandate was “unconstitutionally coercive,” that the Tax Mandate is unconstitutionally ambiguous, and that the Tax Mandate is unrelated to the purpose of the ARPA. The Court found Congress’s Spending Clause authority had been exceeded and that the Tax Mandate amounted to commandeering. As a result, the Court found the “unconstitutionally coercive” nature to be sufficient so there was no need to address the plaintiff’s remaining arguments. The court found the plaintiff met all of the requirements for and granted a permanent injunction against enforcing the Tax Mandate of the ARPA. Because the Court granted the plaintiff’s motion, the defendant’s motion for summary judgment became moot as there was no longer a live issue and did not address the defendant’s legal arguments. 597 F.Supp.3d 1005.

The defendant appealed to the U.S. Court of Appeals for the Fifth Circuit.
