This is a case challenging President Biden's Executive Order (EO 14042) requiring employees of federal contractors to receive the COVID-19 vaccine. On October 29, 2021, the Attorney General of Texas, on behalf of the State of Texas, (“the State)” filed this lawsuit in the U.S. District Court for the Southern District of Texas. The State sued President Biden and the following federal offices (or officials associated with those offices) seeking declaratory relief: the Safer Federal Workforce Task Force, the Federal Acquisition Regulatory Council, the Office of Personnel Management, the Office of Management and Budget, the General Services Administration, the National Aeronautics and Space Administration, the Department of Agriculture, and the Department of Defense. The State challenged EO 14042 on the grounds that the vaccination requirement violated the Procurement Act, the Administrative Procedures Act (APA), and the U.S. Constitution's Spending Clause and non-delegation principle.

On November 15, 2021, the State filed a motion for a Temporary Restraining Order (TRO) seeking to prevent enforcement of the vaccination requirement, arguing it was a violation of Texans’ constitutional rights. The court stayed the case on December 10, 2021, following a ruling from the Southern District of Georgia enacting a nationwide injunction that provided the relief Texas sought. Georgia v. Biden, 574 F. Supp. 3d 1337. On August 26, 2022, the Eleventh Circuit narrowed the Georgia court’s nationwide injunction to the original parties, excluding Texas. 46 F.4th 1283. Subsequently, the district court in this lawsuit ordered supplemental briefing on: 1) whether this case remained a live controversy; 2) how the Eleventh Circuit’s opinion affected the originally requested relief; and 3) what changes, if any, were appropriate to the injunctive relief Texas originally requested. 

After reviewing the briefing, on October 20, 2022, the court issued an order denying the State’s motion for a TRO. The court found that the State had not shown imminent harm stemming from the Executive Order because defendants had, one day prior, issued guidance directing agencies not to enforce the challenged vaccination requirement. Given this directive not to enforce, the court found that EO 14042 posed no threat of immediate harm to Texas, and there was no reason to grant the TRO.

On March 6, 2023, the court held a status conference and lifted the stay. As of April 2023, litigation remains ongoing.
