This case concerns a legal challenge to the vaccine and masking requirements imposed in the federal educational Head Start Programs. On November 30, 2021, an Interim Final Rule with Comment, 86 Fed. Reg. 68,052 was implemented effective immediately, requiring vaccination (and, if an individual has an exemption from vaccination, a requirement of weekly testing) and universal masking for all individuals over two years old at a Head Start facility, including staff and parents. Notice-and-comment procedure was waived due to cited imminent health concerns from the COVID-19 pandemic. On December 10, 2021, the state of Texas and Lubbock Independent School District in Texas filed suit in U.S. District Court in the Northern District of Texas, Lubbock Division against the following parties: the Secretary of Health and Human Services; the U.S. Department of Health and Human Services; the Principal Deputy Assistant Secretary of the Administration for Children and Families; the Administration for Children and Families; Deputy Assistant Secretary for Early Childhood Development, Office of Early Childhood Development; the Office of Early Childhood Development; the Director of the Office of Head Start; the Office of Head Start; and the President of the United States. Plaintiffs argued that the mandates contravene the constitutional mandate of a federal government of limited powers as the Interim Final Rule expressly preempts contrary state and local laws, such as an executive order signed by the Governor of Texas prohibiting mandatory vaccination requirements, and were created and implemented outside of statutorily mandated notice-and-comment rulemaking. Plaintiffs alleged that the Interim Final Rule would commandeer Head Start employees to federalize state and local vaccine policies, impose implementation and enforcement costs on the state, and would infringe upon state sovereignty.

Plaintiffs therefore set out the following claims in their complaint: (1) The Interim Final Rule is not authorized by 2 U.S.C. §9836(a)(1) and not justified by pre-existing rules, as plaintiffs argue the vaccine and mask mandates are neither interpretive rules nor informal interpretations of existing rules. (2) The Interim Final Rule is arbitrary and capricious under 5 U.S.C. § 706(2)(A). (3) Defendants failed to comply with requisite notice-and-comment APA rulemaking requirements (5 U.S.C. § 553), the Congressional Review Act (42 U.S.C. §9836a(a)(2)), or the Treasury and General Appropriations Act of 1999 in promulgating the rule. (4) The Interim Final Rule constitutes an unconstitutional exercise of Spending Power. And (5) The Interim Final Rule violates the Anti-Commandeering Doctrine and the Tenth Amendment. In connection with these claims, plaintiffs sought declaratory relief, declaring defendants’ actions unlawful, and preliminary and permanent injunctive relief to enjoin enforcement. The case was assigned to District Judge James Wesley Hendrix.

On December 14, 2021, plaintiffs filed a motion for a temporary restraining order and preliminary injunction, arguing that nationwide injunctive relief is warranted here because plaintiffs are likely to prevail on their claims that the vaccine and mask mandate are unlawful, and the mandates would cause irreparable harm.

On December 31, 2021, the court granted the plaintiffs’ motion for preliminary injunction, enjoining defendants from the implementation and enforcement of the Interim Final Rule in Texas pending trial on the merits. The court found persuasive the plaintiffs’ argument that the agency acted without proper prior authorization: The court held that the Head Start Act by its plain language did not authorize the power to create and implement vaccine and mask mandates like the ones here. Further, the court held that the rule was not created with proper notice-and-comment rulemaking procedures, and that there was a substantial likelihood that, in its current form, the rule is arbitrary and capricious. Finding that plaintiffs also demonstrated standing and imminent injury arising from the rule, the court held it appropriate to grant a preliminary injunction – but, after reviewing Fifth Circuit precedent on the appropriate scope of injunctive relief, limited the scope of the injunction to Texas, instead of granting the nationwide injunction plaintiffs sought. Having granted injunctive relief, the court denied plaintiffs’ request for a temporary restraining order as moot.

In January 2023, defendants filed with the court a Notice of Final Rule Addressing Masking Requirement. In that notice, defendants informed the court that the Final Rule had been published, and that it incorporated certain changes: It removed the universal masking requirement, and required Head Start Programs to take a flexible “evidence-based COVID-19 migration policy.”

On March 31, 2023, the court granted plaintiffs’ motion for summary judgment, and denied defendants’ motion to the same. The court held that its conclusions were drawn from the same reasoning it employed in deciding plaintiffs’ motion for a preliminary injunction. While the court acknowledged that defendants had modified the Final Rule before publication, it noted that the Final Rule did not address the vaccination and testing requirement at issue in the suit. The court still held that the Head Start Act did not, by its statutory language, authorize the creation of a vaccination mandate like the one at issue here; that defendants failed to follow proper rulemaking procedures in creating the mandates; and that the rule was arbitrary and capricious. As a result, the court vacated the rule. With respect to plaintiffs' other pleas for relief, the court held it denied or otherwise did not reach any other relief requested.

On May 26, 2023, defendants filed a notice of appeal to the Fifth Circuit. On February 2, 2024, a three-judge Fifth Circuit panel comprised of the Honorable Edith H. Jones, Stephen A. Higginson, and James C. Ho denied defendants’ motion to vacate the district court judgment in an unpublished order.

MEMORANDUM OPINION AND ORDER: The Court grants the plaintiffs motion for a preliminary injunction 6 . The Court orders that defendants are preliminarily enjoined from implementing and enforcing the Interim Final Rule with Comment Period, Vaccine a nd Mask Requirements to Mitigate the Spread of COVID-19 in Head Start Programs, 86 Fed. Reg. 68,052 (Nov. 30, 2021), in the state of Texas pending a trial on the merits of this action or until further order of this Court. Defendants shall immediately cease all implementation or enforcement of the Interim Final Rule with Comment Period as to any Head Start program within the State of Texas. Because defendants have appeared and the Court conducted a hearing on plaintiffs motion 6 , Federal Rule o f Civil Procedure 65(b) no longer applies. See e.g., New England Health Care, Emps. Union, Dist. 1199, SEIU/AFL-CIO v. Rowland, 170 F. Supp. 2d 199, 201 n.2 (D. Conn. 2001) (denying TRO as moot in light of the hearing on the preliminary motion).
