On September 2, 2021, twelve volunteer legal observers for the New York City Chapter of the National Lawyers Guild (NLG) filed suit in the U.S. District Court for the Southern District of New York against the City of New York, the New York Police Department (NYPD), City officials, and individual police officers in their official capacities. The plaintiffs, represented by private counsel, brought this action under 42 U.S.C. § 1983, the New York State Constitution, and New York state law, alleging violations of their First, Fourth, and Fourteenth Amendment rights. The complaint sought damages and declaratory and injunctive relief; specifically, actual and punitive damages, attorney’s fees, a declaratory judgment stating the defendants’ violations of the plaintiffs’ rights, and permanent injunctive relief to prevent future violations of the plaintiffs’ rights.

On June 4, 2020, the plaintiffs attended the racial justice protest in the Mott Haven neighborhood of the Bronx as NLG legal observers, intending to observe and document the police response to the protest. The complaint alleged that at that protest, at around 7:45pm, the NYPD used a police maneuver known as “kettling” to surround peaceful protesters, including the plaintiffs, with police officers, entrap them in a small area, and arrest them. Once these protesters were kettled, police officers used their fists, batons, and bicycles to beat the protesters and sprayed them with pepper spray. NYPD officers then arrested protesters and cuffed them so tightly with flex-cuffs that some suffered injuries or long-term nerve damage. Despite all wearing neon green hats and badges that clearly identified the plaintiffs as NLG legal observers, the plaintiffs were singled out, cuffed, and subjected to processing and detention in close proximity to other arrestees for hours, heightening their risk of contracting COVID-19. NYPD officers also allegedly seized or destroyed confidential legal observer notes.

The complaint further alleged that, despite written NYPD policies and a 1977 stipulation and order that recognized the public’s right to record, observe, and photograph police activity in public places, the NYPD had a longstanding practice of violating the rights of observers. The complaint alleged that the City, Mayor Bill de Blasio, Police Commissioner Shea, and other supervisory members of the NYPD had knowledge of—and knowingly failed to correct—this unconstitutional practice, failed to properly train NYPD officers on observers’ right to document police activity in public places, and failed to properly supervise and discipline officers who did not respect observers’ First Amendment rights. Finally, the complaint alleged that the City had declared NLG observers essential workers on June 1, 2020, exempting the plaintiffs from the 8 pm curfew, further undermining the basis upon which the plaintiffs had been arrested.

On September 3, 2021, the case was referred to Judge Colleen McMahon and Magistrate Judge Gabriel Gorenstein as possibly related to the consolidated action of other police conduct-related cases arising from the 2020 racial justice protests in New York, captioned as In re: New York City Policing During Summer 2020 Demonstrations. This case was accepted as related on September 27, 2021. On July 21, 2022, the plaintiffs filed a notice of their acceptance of the defendants’ Rule 68 offer of judgment. The court entered the judgment on July 26, 2022. Under the judgment, each plaintiff received between $2,501 and $10,001 in damages. The court retained jurisdiction to enforce the judgment.

As of March 17, 2023, the court was waiting on fee applications from the plaintiffs and the case remained open.

STIPULATION AND ORDER OF SETTLEMENT OF ATTORNEY'S FEES, COSTS, AND EXPENSES: NOW, THEREFORE, IT IS HEREBY STIPULATED AND AGREED, by and between the undersigned, as follows: 1. The above-referenced remaining claims for attorney's fees, expenses, and costs are hereby resolved, with prejudice, and without attorney's costs, expenses, or fees in excess of the amount specific in paragraph '2' below. 2. Defendant City of New York hereby agrees to pay attorneys' fees in the amount of Three Hundred Thousand Dollars ($300,000.00) to Cohen & Green P.L.L.C. and Gideon O. Oliver, Esq. as attorneys for Plaintiffs Krystin Hernandez, Natalie Baker, Ethan Chiel, Kyla Raskin, Rex Santus, Roxanne Zech, Rafael-Lev Gilbert, Sarah Mills-Dirlam, August Leinbach, Jalen Matney, Jonathan Davis, and David Holton, in full satisfaction of all plaintiffs' claims for attorneys' fees, expenses, and costs. In consideration for the payment of Three Hundred Thousand Dollars ($300,000.00), counsel for plaintiffs agree to release and discharge defendants City of New York; Mayor Bill De Blasio; Dermot Shea; Terence Monahan; Ernest F.
