On December 7, 2020, four private individuals who attended racial justice protests in the Mott Haven neighborhood of the Bronx filed suit in the U.S. District Court for the Southern District of New York against the City of New York, the New York City Police Department (the NYPD), City officials, and police officers in their individual capacities. The plaintiffs brought this action on behalf of themselves and  a putative class under 42 U.S.C. § 1983 to remedy violations of their First, Fourth, and Fourteenth Amendment rights. The lawsuit sought declaratory and compensatory relief.

The complaint alleged that on June 4, 2020, the defendants intimidated, assaulted, and unlawfully arrested protesters in Mott Haven in order to suppress their calls for racial justice and police reform. Specifically, the NYPD, with the approval of City officials, used a police maneuver known as “kettling” to surround peaceful protesters with police officers, entrap them in a small area, and arrest them. The “kettled” protesters were pushed tightly together while officers with batons and shields struck people on the edges and pulled down face masks to pepper spray protesters directly in the face, leaving many injured and causing some to faint or lose consciousness. The complaint also alleged that officers violently threw protesters to the ground while arresting them, and when cuffing the protesters, the officers cinched the zip-tie cuffs so tightly that protesters’ hands turned purple and numb. Once in custody, protesters were held for anywhere between 6 and 20 hours. The plaintiffs further alleged that, despite the ongoing COVID-19 pandemic, police officers responding to protests frequently failed to wear masks or to assist cuffed protesters in covering their noses and mouths, exposing protesters to a heightened risk of contracting COVID-19.

The complaint further alleged that the events in Mott Haven were not unique. It referenced Gelbard v. City of New York, 1:20-cv-03163, and Payne v. de Blasio in asserting that the NYPD’s actions had been replicated at other racial justice protests. The complaint also alleged that the actions of the NYPD on June 4 had been endorsed by City officials in public statements leading up to the protests.

The case was originally assigned to Judge J. Paul Oetken. In February 2021, the case was accepted as related to other police conduct cases filed after the 2020 racial justice protests and reassigned to Judge Colleen McMahon and Magistrate Judge Gabriel W. Gorenstein. It was officially consolidated with the other protest cases in April 2021, captioned as In re: New York City Policing During Summer 2020 Demonstrations. In early March 2021, the Police Benevolent Association of the City of New York, the Sergeants’ Benevolent Association of New York City, and the Detectives’ Endowment Association of New York City moved to intervene in some or all of the consolidated cases. On April 28, 2021, Judge McMahon denied all three of the unions’ motions to intervene without prejudice for renewal, reasoning that until the litigation reached a point at which a settlement or injunctive relief was more than merely speculative, the unions were not facing any “practical impact” sufficient to warrant intervention. The PBA appealed. On March 4, 2022, the U.S. Court of Appeals for the Second Circuit affirmed in part and reversed in part the trial court’s decision, holding that the PBA’s interest in officer safety was a cognizable interest that warranted intervention in the actions seeking declaratory and injunctive relief, but not in the actions seeking monetary damages only. On remand, the trial court was instructed to grant the PBA’s motion to intervene. The motion was granted in June 2022.

While the unions’ appeal was pending before the Second Circuit, the case proceeded through discovery at the district court level. On July 9, 2021, Judge McMahon granted in part and denied in part the defendants’ motion to dismiss the amended complaints in the consolidated action. All claims against Mayor de Blasio, Police Commissioner Shea, and Police Chief Monahan in their official capacities were dismissed as redundant in the face of the claims made against the municipality. Judge McMahon also dismissed all claims against Commissioner Shea in his individual capacity, citing a lack of any indication in the record that he was personally involved in violating the plaintiffs’ constitutional rights. The court further held that the curfew orders issued and enforced by the City during the protests were lawful, and therefore dismissed all of the claims made by the Sow v. City of New York plaintiffs relating to the curfew. The court denied the motion as to the remaining claims in all cases and allowed those claims to proceed.

Mediation conferences began in July 2022. On September 15, 2022, the court granted the plaintiffs’ motion to file a consolidated and amended class action complaint. The amended complaint added additional allegations of the NYPD’s long history of racially-biased policing and indifference to bias in the police department, despite a 2019 report that recommended the NYPD amend its policies around the reporting and investigation of biased policing. The amended complaint also added causes of action under state law for false arrest and false imprisonment; assault and battery; denial of medical attention; intentional or negligent infliction of emotional distress; negligent hiring, screening, retention, training, supervision, and discipline; and excessive detention.

On February 28, 2023, the plaintiffs filed a memorandum of law in support of their motion for approval of a class settlement in this case as well as Wood v. de Blasio, which the court granted on March 3, 2023. The Wood and Sierra class members each received $21,500. Class members who received a desk appearance ticket during the 2020 protests received an extra $2,500.

As of March 4, 2023, the rest of the cases in the consolidated action were proceeding through the discovery process.
