On March 21, 2018, the plaintiff—a resident of the city of Tukwila, Washington represented by the Northwest Immigrant Rights Project—filed a complaint in the United States District Court for the Western District of Washington against the Tukwila Police Department and its law enforcement officers for wrongfully detaining him. The plaintiff had initially called 9-1-1 over concerns with a trespasser on his property; however, upon law enforcement officers from the Tukwila Police Department arriving at his home, the officers detained the plaintiff without probable cause or reasonable belief that the plaintiff committed a crime. Instead, the officers detained the plaintiff following a dispatcher report that the plaintiff was in the country without a lawful immigration status, as evidenced by a previous order of removal. Once inside the patrol vehicle, the officers showed the plaintiff an Administrative Warrant of Removal from the United States and took him into custody on behalf of Immigration and Customs Enforcement (“ICE”). The plaintiff was eventually transferred into ICE custody and was sent to a detention facility in Tacoma, Washington.

The complaint, thus, alleged that the defendants’ seizure of the plaintiff without probable cause was a violation of the Fourth Amendment. Noting that the officers had no lawful authority to seize the plaintiff for purposes of investigating his civil immigration status, the complaint asserted that the plaintiff had the right to be free from unreasonable seizures. As to the city itself, the complaint argued that the city had an unlawful policy or practice of detaining individuals based on any type of warrant. Along with compensatory and punitive damages, the plaintiff sought declaratory and injunctive relief, requesting the court to prohibit the defendants from detaining or arresting an individual to investigate their potential unlawful status or an individual sought by federal immigration officers. The case was assigned to Judge Richard A. Jones. 

Defendants filed an answer to the complaint on April 19, 2018, with a demand for a jury trial. Given the party’s willingness to proceed with litigation, the court immediately set the discovery deadline for December 10, 2018 and jury trial for April 8, 2019, and discovery commenced.

As discovery remained ongoing, the defendant-officers filed a motion for partial summary judgment on October 11, 2018. The following day, the defendants also filed a motion to seal the order of removal issued for Plaintiff by the United States Immigration Court. The defendant-city also filed a motion for summary judgment on January 8, 2019. In response to the city’s motion, the plaintiff filed a motion for partial summary judgment on January 8 as well. 

An amended trial date was set in February, extending the jury trial to commence on June 10, 2019. 

In a joint order addressing all of these motions, on May 8, 2019, the court granted the motion to seal, granted in part the plaintiff’s motion for partial summary judgment, denied in part the defendant-officers’ motion for summary judgment, and granted the defendant-city’s motion. First, the court allowed the removal order to be filed under seal such that the plaintiff’s immigration status would be shielded from public view. As for the summary judgment motions, the court found that the defendant-officers violated the plaintiff’s Fourth Amendment rights by seizing him only upon knowledge of suspected unlawful presence. In response to the defendant-officers’ argument regarding qualified immunity, the court also found that the plaintiff’s Fourth Amendment right was clearly established. Noting that the officers did not even confirm the ICE warrant before seizing the plaintiff, the court rejected their motion for qualified immunity. Despite these findings, the court noted that there were factual disputes as to the involvement and motivation of certain officers on the scene, and so the court denied the officers’ motion only in part. As to the claim against the city, the court granted summary judgment in favor of the city. The court noted that although the plaintiff’s encounter supported an inference that the city’s training on civil immigration violations was severely negligent, no jury would conclude that it was the result of deliberate indifference. 378 F.Supp.3d 933. 

Following the court’s order, on May 28, 2019, the parties filed a joint request to continue the trial date, specifically in aims to settle instead. Following negotiations, the parties notified the court of a settlement agreement, and requested all pending motions and the jury trial to be stricken from the calendar. The contents of the settlement, though, are unknown to the public. 

In light of the settlement, the court dismissed the case with prejudice on May 31, 2019. The case is now closed.
