​​This case concerned the constitutionality of the Metropolitan Police Department of the District of Columbia ("MPD")’s stop-and-frisk policy. MPD’s special Gun Recovery Unit ("GRU") finds and recovers illegal firearms. Three Black individuals who were stopped and frisked by the GRU brought a class action lawsuit in the United States District Court for the District of Columbia on April 30, 2020. They sued the District of Columbia under 42 U.S.C. § 1983. Represented by private counsel, the plaintiffs alleged that the GRU violated the Fourth Amendment by stopping, frisking, arresting, and detaining individuals without reasonable suspicion or probable cause; fabricated facts to retroactively justify reasonable suspicion; and specifically targeted Black individuals for searches in violation of the Fifth Amendment’s Equal Protection provision. The plaintiffs requested damages for injuries suffered by the named plaintiffs and members of the class, injunctive and declaratory relief, and attorneys’ fees. The case was assigned to District Judge Tanya S. Chutkan.

The plaintiffs filed an amended complaint on September 30, 2020, which added a fourth named plaintiff and alleged that the defendant failed to adequately screen, train, supervise, and discipline MPD officers. The amended complaint also added nine individual MPD officers as defendants (in their individual and official capacities) and requested punitive damages from each of them.

On November 16, 2020, the District of Columbia moved to dismiss the amended complaint.

Judge Chutkan denied the District of Columbia's motion to dismiss on March 29, 2023. The court held that the plaintiffs sufficiently alleged that the GRU officers acted with racially discriminatory intent and lacked the requisite reasonable suspicion to stop and search named plaintiffs. Judge Chutkan also held that the MPD officers were not entitled to qualified immunity because a reasonable police officer would understand that stopping and searching someone without reasonable suspicion or probable cause is unlawful. Lastly, the court found that the plaintiffs sufficiently established the District of Columbia's municipal liability. 

On January 31, 2024, the parties filed a joint motion for a referral to a magistrate judge for mediation; the parties also moved to stay. Judge Tanya Chutkan granted the joint motion on February 6, 2024, and the case was referred to Magistrate Judge Moxila Upadhyaya for mediation. All deadlines were stayed. 

On June 5, the parties reached a settlement. The terms of the settlement are unknown to the Clearinghouse at this time. Judge Chutkan ordered the parties to file a stipulation of dismissal or joint status report on or before July 8, 2024. The case was dismissed on June 24, 2024.

When proposing deadlines, the parties shall avoid proposing a schedule that contains submission of simultaneous dispositive cross-motions. In addition to the requirements under the Federal and Local Rules, the parties' report shall contain a succinct summary of the case and the statutory basis for all causes of action and defenses. Counsel who attend the Scheduling Conference must be sufficiently familiar with the case to answer any questions which arise and hold the authority to make stipulations and admissions about all matters that can reasonably be anticipated for discussion.
