This is a case about the right of public high school students in California to form a gay-straight alliance and be recognized as a student club. Students in the Orange Unified School District Board applied to form the alliance, and the Board deferred action on that application for months. During this period, the students did not have permission to meet. After several months, the Board formally denied the application, insisting that it would only reconsider the application if the group changed its name and agreed to limitations on their speech. In particular, the students were asked not to discuss "sex, sexuality, [and] sex education."

On behalf of the club's student founder and members, Lambda Legal and People For the American Way Foundation filed this lawsuit against the Board, superintendent, and school principal on November 24, 1999 in the United States District Court for the Central District of California, challenging the Board's decision. The plaintiffs alleged violations of the Equal Access Act in addition to violations of their Fourteenth Amendment rights to expression, association, and equal protection. Plaintiffs also raised state constitutional claims. They sought declaratory judgment, preliminary and permanent injunctive relief, damages, and attorneys' fees. The case was assigned to Judge David O. Carter.

On December 21, 1999, the plaintiffs filed an amended complaint to add some additional facts. A few days later on December 29, 1999, the plaintiffs motioned for a preliminary injunction. The Court held a hearing, and on February 4, 2000, Judge Carter granted the preliminary injunction. 83 F. Supp. 2d 1135. In particular, Judge Carter held that the plaintiffs showed a likely violation of the Equal Access Act because the high school accepted federal funds, established a "limited open forum" by allowing other student groups to meet on school premises during non-instructional times, and discriminated against the students of the gay-straight alliance due to the content of the speech that would take place at their proposed meetings. Due to these findings, the Court did not reach the plaintiffs' constitutional claims. Because the Court found that the plaintiffs would be irreparably injured absent preliminary relief and such preliminary relief was in the public interest, Judge Carter granted the preliminary injunction, allowing the alliance to meet pending trial. This was especially notable because it was the first time that a court ordered a school to allow a gay-straight alliance to meet on campus. This opinion has been invoked in several subsequent lawsuits.

After a few months of discovery, the parties began settlement talks in May 2000. Discovery and the settlement talks continued simultaneously, and on September 7, 2000, a settlement favorable to the plaintiffs was reached. The settlement gave the plaintiffs everything they had sought in their lawsuit, including approval of the gay-straight alliance with guarantees of equal access and freedom to discuss "sexual activity." As a condition of the settlement, the lawsuit was dismissed, but the court retained jurisdiction for three years in case of disputes. 

Pursuant to the settlement agreement, the case was dismissed on September 28, 2000, and there were no docketed disputes in the three following years. The case is closed now.
