This case was filed after two Lakota children had their hair cut twice, contrary to their traditional and religious beliefs, by school employees during lice checks, the second time after the parents of the children voiced concerns. Two parents and two students, represented by the ACLU of Nebraska, filed suit against the Cody-Kilgore Unified School District and two school employees in the U.S. District Court for the District of Nebraska on May 17, 2021, alleging that the school had an unwritten practice of cutting hair for lice checks, which violated its official policy and was only applied to Native American students. The plaintiffs sued under 42 U.S.C. § 1983, alleging that this violated the First Amendment rights of the students to free religious exercise and the Fourteenth Amendment due process rights of their parents to choose the religious and cultural upbringing of their children. They also brought a claim under Title VI of the Civil Rights Act for racial discrimination. The plaintiffs requested monetary damages and attorneys' fees. The case was assigned to Judge John M. Gerrard.

On July 15, 2021, Defendants submitted a motion to dismiss for failure to state a claim, arguing that the Plaintiffs had not sufficiently alleged facts showing the conduct violated their First or Fourteenth Amendment rights. On November 10, 2021, the court granted in part and denied in part the motion. It found that the plaintiffs had alleged sufficient facts to show an unconstitutional District policy which resulted in violations of the students' Free Exercise rights. The court also held that the individual defendants were not entitled to qualified immunity on the face of the complaint. Further, the court allowed the Title VI claims to proceed. However, the court dismissed the Fourteenth Amendment due process claims.

On February 11, 2022, the plaintiffs filed an amended complaint that again brought claims based on the First and Fourteenth Amendments, as well as Title VI. The plaintiffs also added claims for violations of the Fourteenth Amendment's Equal Protection Clause based on racial and religious discrimination.

The parties ultimately settled the case and on October 4, 2023, the court entered a Consent Decree. Under the Consent Decree, the court ordered the School District to: (1) implement a general policy prohibiting school officials from cutting students hair for any reason without written consent of their parents or guardians, (2) provide staff training on cultural competency including, but not limited to, Native American culture; and (3) recognize Indigenous Peoples’ Day and Native American Heritage Month. In addition, the court ordered the School District to pay the plaintiffs a total of $227,500. The Consent Decree was set to last for five years.

As of April 2025, there were no further developments, and the Consent Decree is presumably still in effect.
