On May 24, 2023, Plaintiffs Florida State Conference of Branches and Youth Units of the NAACP, Voters of Tomorrow Action, Inc., Disability Rights Florida (the Florida protection and advocacy system), Alianza for Progress, Alianza Center, and UnidosUS, filed a lawsuit challenging provisions of a recently-passed state law, Senate Bill 7050, that imposed restrictions and penalties on third-party voter registration organizations that sought to register eligible Floridians to vote and put limitations on voter assistance options for requesting a mail-in ballot. The plaintiffs claimed that the challenged provisions of S.B. 7050 violated the First and 14th Amendments of the U.S. Constitution. Additionally, the plaintiffs challenged a provision of S.B. 7050 that only allowed county supervisors to accept requests for mail-in ballots from voters or their immediate family members, arguing that this provision denied voters with disabilities and limited-English voters their choice of voter assistance in violation of the Voting Rights Act Section 208. Represented by the Elias Law Group, the plaintiffs filed suit in the Northern District of Florida against the Florida Secretary of State, the Attorney General, and supervisors of elections. Plaintiffs sought declaratory and injunctive relief. The case was assigned to the Honorable Mark Walker.

On June 9, 2023, plaintiffs filed an amended complaint adding several individual plaintiffs. 

Plaintiffs moved for a preliminary injunction on June 9, 2023 as to two of the challenged provisions: (1) the prohibition on noncitizens conducting voter registration, and (2) the ban on retention of voter contact information by voter registration organizations.  On July 3, 2023, the court granted the plaintiffs' preliminary injunction motion.  The Defendants appealed the case on July 11, 2023.

On July 25, 2023, the court consolidated this case with a similar case (docket no. 4:23cv218) for the bench trial. 

On August 3, 2023, the defendants filed a motion to dismiss. Defendants alleged that plaintiffs had not standing to sue the supervisors of elections, as they could not enforce the fine provision of the statute (97.0575(5)(a)). 

On August 16, 2023, the plaintiffs filed a second amended complaint. 

On December 6, 2023, the plaintiffs filed a third amended complaint. 

On January 12, 2024, the court denied the motion to dismiss. 

On January 18, 2024, the defendant Secretary of State filed a motion for summary judgment. Defendant alleged that the mail-in ballot restriction did not conflict with any federal law, as the statute specifically allowed a voter who requires assistance to vote by reason of blindness, disability, or inability to read or write to be given assistance by a person of his or her choice.

On January 23, 2024, the plaintiffs filed a motion for partial summary judgment. Plaintiffs alleged that the citizenship requirement of the statute was preempted by the Equal Protection Clause of the 14th Amendment, and the mail-in ballot provision was preempted by the Voting Rights Act. 

On March 5, 2024, the court granted the plaintiffs' motion for summary judgment in part as to the Equal Protection Claim. The court granted the defendant's motion for summary judgment in part and denied in part. 

The parties engaged in a bench trial during the spring.

On April 22, 2024, the plaintiffs filed a fourth amended complaint. 

The case is ongoing.
