​​This is a case about the constitutionality of a Florida immigration law. On July 17, 2023, the Farmworker Association of Florida and individual defendants sued the Governor of Florida, the Florida Attorney General, the Florida Statewide Prosecutor, and Florida's State Attorneys in the U.S. District Court for the Southern District of Florida. The plaintiffs challenged the constitutionality of Section 10 of Senate Bill 1718, which made it a crime to transport a person into Florida if that person "entered the United States in violation of law and has not been inspected by the Federal Government since his or her unlawful entry." The plaintiffs alleged that Section 10 violated the Supremacy Clause of the US Constitution and the Due Process Clause of the Fourteenth Amendment.

Specifically, the plaintiffs argued that Section 10 violated the Supremacy Clause because immigration is a federal matter, and current federal immigration law preempts any analogous state laws. The plaintiffs argued that 8 U.S.C. § 1324 already regulates immigration matters, specifically smuggling, and that this state law would cover the same subject matter and add additional prohibitions. It would also cause problems for the federal immigration system because it would make it difficult for people in other states to come to immigration court or immigration appointments/check-ins in Florida. In addition, the plaintiffs argued that Section 10 was “impermissibly vague and incoherent,” in violation of the Due Process clause, due to its lack of definition of the term “inspect,” leading to arbitrary enforcement of the law. Represented by attorneys from the Southern Poverty Law Center, Americans for Immigrant Justice, the American Immigration Council, and the ACLU, the plaintiffs sought declaratory and injunctive relief, as well as attorneys' fees. The case was assigned to Judge Roy K. Altman and Magistrate Judge Lisette M. Reid.

On August 8, 2023, the plaintiffs filed a motion for preliminary injunction. The same day, the court rejected the motion as premature. On August 24, 2023, the plaintiffs filed a second motion for preliminary injunction which has yet to be decided. 

The following month, on September 15, the Governor of Florida filed a motion to dismiss for failure to state a claim and lack of subject matter jurisdiction. Governor DeSantis argued that sovereign immunity barred the claims against him. He also argued that the plaintiffs did not have standing, as their injuries were “neither traceable nor redressable” to him. 

On December 13, 2023, Judge Roy K. Altman granted the governor’s motion to dismiss himself from the case. 2023 WL 8878306. In his decision, the judge argued that the plaintiffs did not have standing to sue, based on both lack of traceability from the alleged injury to the governor’s actions as well as an argument that the plaintiff’s requested injunction would not directly redress the injury. The judge also agreed with the Governor that the Eleventh Amendment granted him immunity from such a suit, saying that Florida’s governor does not have the capacity to directly enforce the law, which means the suit is wrongly aimed and the Eleventh Amendment protects him from such legal action. However, the case continued against Florida’s Attorney General, Ashley Moody.

On May 22, 2024, Judge Altman granted plaintiff’s motion for a preliminary injunction against 10 SB 718. 2024 WL 2310150. This time, the judge strongly dismissed defendants’ arguments that the plaintiffs lack standing, and while he thought that the plaintiffs’ due process arguments failed to be convincing, he argued that the plaintiffs effectively argued that 10 SB 718 was preempted by federal law due to it effectively deputizing Florida authorities to make arrests for federal immigration law violations. The judge was also convinced by plaintiffs’ arguments that the law represented an irreparable injury towards them, and found that the equitable factors weighed on the side of the plaintiffs.

On June 6, 2024, Florida Attorney General Nicholas B. Cox filed a motion to reconsider the preliminary injunction.

As of September 9, 2024, the case is ongoing.

The Motion is therefore premature. See Doc Dev., LLC v. Ewc Franchise Group, Inc., 2018 WL 2007045, at *1 (S.D. Fla. Mar. 23, 2018) ("There is no indication on the docket [d]efendant has been served with the [complaint], nor has [d]efendant appeared in this action. The [m]otion's Certificate of Service, stating the [m]otion was 'furnished' to two individuals 'via electronic mail,' is not proof of service of the [c]omplaint. [ ] Defendant is not expected or required to respond to a request for a preliminary injunction contained in a motion until it has been served; thus, the request for a preliminary injunction is premature."). The Plaintiffs may re-file their Motion once the Defendants have been served. We also deny without prejudice 17 the Plaintiffs' Motion for Leave to Proceed Anonymously. As we've said, the Plaintiffs have not yet filed proof of service on the Docket, so the Motion to Proceed Anonymously is premature. The Defendants say that "it is difficult for the State Defendants to prepare party-specific arguments on issues like standing and irreparable harm without knowing how the Court will resolve these pending issues." Motion at 2. They add that they "cannot determine at this time whether to seek discovery before a hearing on the Motion for Preliminary Injunction," and that "it would be a better use of the parties' and this Court's resources to stay the briefing pending resolution of the anonymity issue." Ibid. After careful review of the Motion and the Plaintiffs' Response, see 45, we don't think these reasons are sufficient to justify a protracted stay of the Motion for Preliminary Injunction, see 30 . For one thing, if the Defendants want to seek discovery before the preliminary-injunction hearing, they'll have to show "good cause." See, e.g., FTC v. On Point Glob. LLC, 2020 WL 32996, at *2 (S.D. Fla. Jan. 2, 2020) (Scola, J.). For another, the Defendants don't explain how our ruling on the question of anonymity will affect their decision to seek discovery. As to the "difficulty" of preparing party-specific arguments, the same could be said of almost any complex case. "Ultimately, we enjoy broad discretion in deciding how to best manage the cases before us," Sizemore v. Zhao, 2023 WL 5087341, at *1 (S.D. Fla. Aug. 8, 2023) (Altman, J.) (cleaned up). In this case, we think it makes more sense for the parties to brief both motions (for a preliminary injunction and to proceed anonymously) at the same time. Signed by Judge Roy K.
