This is a case about access to Special Immigrant Juvenile Status for immigrant children under the care of the Tennessee Department of Children’s Services. 

On July 24, 2023, several immigrant youths under the care of Tennessee Department of Children’s Services (DCS) and Advocates for Immigrant Rights (AIR) filed this class action lawsuit in United States District Court for the Middle District of Tennessee. Plaintiffs brought this lawsuit for declaratory and injunctive relief against Tennessee’s DCS under 42 U.S.C. § 1983. The plaintiffs sought an order declaring that the defendant violated the plaintiffs’ Fourteenth Amendment procedural due process rights by not assisting the plaintiffs with timely immigration applications, and an injunction requiring the defendant to establish and implement procedures to ensure eligible youth under their care seek immigration relief in a timely manner. This case was assigned to Judge Campbell.

Tennessee DCS serves as the legal guardian for the plaintiffs due to their placement within the state’s foster care system. The plaintiffs lack legal immigration status but are eligible for Special Immigrant Juvenile Status (SIJS). SIJS is available to child immigrants and provides them with many benefits including a pathway to lawful permanent resident status and United States citizenship. Child immigrants are required to submit an application for SIJS before their eighteenth birthday or forever lose the opportunity.

On December 19, 2023, the parties jointly filed their draft settlement agreement with the court for review and approval. Under the terms of the agreement, the defendant agreed to draft, and make public, the Department’s policy concerning foreign-born children under their care. The policy, among other things, will include procedures for identifying qualifying children, internal tracking measures, establishing a centralized, internal team dedicated to immigration related needs, and refer cases to organizations and attorneys that handle immigration proceedings. The defendant did not admit guilt in the agreement, but they further agreed to pay $75,000 for the plaintiffs’ attorney’s fees.

On February 12, 2024, the court entered an order approving the terms of the parties’ settlement agreement and dismissed the case with prejudice as called for in the settlement agreement.

This case is now closed.
