This case involves allegations of discrimination and abuse experienced by transgender individuals held in police custody. During the 2020 Black Lives Matter protests, three transgender protesters were arrested in Miami Dade County and held overnight at Turner Guilford Knight Correctional Center (“TGK”). While in police custody, plaintiffs allegedly faced discrimination and abuse at the hands of Miami-Dade County Department of Corrections and Rehabilitation (“MDCR”) staff, including harassment based on their sex, disability, and transgender status.

On January 31, 2022, plaintiffs filed a lawsuit in the Southern District of Florida against Miami-Dade County, the MDCR, and several officers. They sued under 42 U.S.C. § 1983, alleging violations of the Fourth Amendment's protections from unreasonable search and seizure and the Equal Protection and Due Process Clauses of the Fourteenth Amendment. They also brought claims under the Americans with Disabilities Act (“ADA”). Represented by the Southern Poverty Law Center, plaintiffs sought declaratory relief, compensatory and punitive damages, and attorneys’ fees. Prior to filing the lawsuit, plaintiffs and their counsel sent a letter to the county seeking resolution and proposed recommended changes to the jail's policies and practices. These proposed changes included: housing transgender people where they will be safest during custody, allowing transgender people to dress according to their identity, ending the practice of strip-searching people because they are transgender, and ensuring that someone’s transgender status is not disclosed to anyone without a need to know, among others. However, the county allegedly failed to negotiate with plaintiffs, and the complaint was filed.

Specifically, the complaint alleged that defendants created and enforced both written and unwritten policies and customs that subjected transgender individuals to worse treatment, in violation of the Equal Protection Clause. These policies and customs included strip searches solely for being transgender, placement in solitary cells, and persistent misgendering and harassment. Plaintiffs also claimed that defendants violated their right as pre-trial detainees to be free from conditions that amount to punishment, as well as their right to privacy, both under the Due Process Clause of the Fourteenth Amendment. Plaintiffs alleged that the county was deliberately indifferent to their serious medical needs and failed to protect them from unnecessary disclosure of medical and personal information. Additionally, plaintiffs alleged that defendants had a policy of singling out transgender individuals for strip searches, subjecting them to discriminatory and arbitrary searches in violation of the Fourth Amendment. Finally, the plaintiffs alleged that the defendants had violated the ADA by discriminating against them based on their gender dysphoria, as well as using additional force against one plaintiff who had a physical disability. The case was assigned to Judge Kathleen M. Williams.

On July 25, 2022, plaintiffs filed a notice of settlement, indicating that the defendants would pay $145,000 in exchange for a release of all claims. Before the parties settled, the MDCR promulgated a new policy relating to the treatment of LGBTQ+ and gender non-conforming inmates. The policy declared that the MDCR sought to create an environment without discrimination based on gender identity or sexual orientation. It contained specific guidelines related to gender identification during intake, communication by corrections officers, frisk and strip search procedures, classification and housing, healthcare, hygiene, and the creation of a committee to ensure a safe environment for transgender inmates.

The court dismissed the case on September 23, 2022, and it is now closed.
