On February 17, 2023, CoreCivic—a corporation operating private correctional and detention facilities—filed a complaint in the U.S. District Court for the District of New Jersey against the Governor and Attorney General of the state regarding New Jersey Assembly Bill 5207. AB-5207, the plaintiff claimed, prohibited Immigration and Customs Enforcement (“ICE”) from renewing contracts under which CoreCivic managed and operated the Elizabeth Detention Center (“EDC”) in Elizabeth, New Jersey. Noting that the federal government has the power to detain individuals in connection with federal immigration proceedings and to make arrangements with third parties to house detainees, the complaint alleged that the state law interfered with a federal regulatory matter. Thus, the complaint argued that federal law preempted AB-5207 and that state law was a violation of intergovernmental immunity as it discriminated against who the federal government dealt with. The plaintiff was represented by private counsel and requested declaratory and injunctive relief. The case was initially assigned to Judge Michael A. Shipp, but was then reassigned to Judge Robert Kirsch. 

On May 17, 2023, the defendants filed a motion to dismiss the case for lack of Article III standing. Seemingly in response to these concerns, the plaintiff filed a first amended complaint on June 7. The defendants, then, wrote to the court seeking to withdraw the pending motion to dismiss. 

On June 14, 2023, CoreCivic filed a motion for preliminary injunction, requesting the court to first declare that the state law did not prevent CoreCivic from negotiating or contracting with ICE, and second enjoining the state from taking any action to enforce AB 5207 so as to prevent CoreCivic from negotiating or contracting with ICE. Following telephone conferences, the court set a briefing schedule and set a hearing on the matter on August 14, 2023. 

The United States then filed a statement of interest on July 19, 2023 in support of CoreCivic’s motion to enjoin AB 5207. The federal government claimed that the state law violated the Supremacy Clause and an injunction was necessary to prevent immediate and irreparable harm to the federal government and the public. 

Following the August 14 hearing, on August 29, the court entered judgment in favor of CoreCivic, permanently enjoining the defendants from enforcing AB 5207 against CoreCivic with respect to its relationship with ICE. The court noted that a state law that deprived the federal government of its chosen method of detaining individuals for violating federal immigration law could not survive Supremacy Clause scrutiny. The court determined that Congress's assignment to the federal government the responsibilities to enforce the immigration laws, including detention, rendered AB 5207 unconstitutional. 690 F.Supp.3d 467. 

The defendants then appealed this order to the Third Circuit. The case was docketed as 23-2598. 

On appeal, the parties began briefings on the matter. The ACLU of New Jersey and 27 other community organizations in support of the defendants’ appeal. Oral arguments were then scheduled for May 1, 2025. 

The case remains ongoing.

TEXT ORDER: As the parties are aware, the Court will hear oral argument on Plaintiff's Motion for a Preliminary Injunction (ECF No. 17 ) on Monday, August 14, 2023 at 10:00 a.m. At a previous Telephone Conference, the parties indicated that they would not offer witness testimony at the hearing but rather would rely on oral argument and their written submissions (ECF No. 33 ). The Court is in receipt of the Statement of Interest of the United States (ECF No. 37 ), which requests the Court to consolidate next week's hearing for preliminary relief with a trial on the merits pursuant to Federal Rule of Civil Procedure 65(a)(2). Plaintiff and Defendants in their subsequent filings (ECF Nos. 41 and 45 ) did not address the United Statess request. In the event that the parties consent, the Court is agreeable to advance the full trial of Plaintiffs claims on the merits and consolidate that trial with its hearing on Plaintiffs motion for a preliminary injunction pursuant to Rule 65(a)(2). The Court hereby orders the parties to file on the docket by Thursday, August 10, 2023 at 12:00 p.m. noon a joint letter advising the Court whether the parties consent to the Court entering a final decision on the merits of Plaintiff's Complaint after the hearing on August 14, 2023.
