Case Summary

(This summary is temporary, while we research this case.) In the summer of 2020, a transgender woman was arrested during a Black Lives Matter protest in El Paso County, Colorado. She then faced discrimination and abuse because of her gender identity while detained in jail. On June 1, 2022, she filed a complaint against El Paso County, seeking damages for the discrimination she alleged. Parties reached a settlement agreement in March 2023.

ORDER. The Court has under advisement 26 Defendants’ Motion to Dismiss First Amended Complaint Under Fed. R. Civ. P. 12(b)(1) and (6) and 41 Defendants’ Supplemental Motion to Dismiss Second Amended Complaint Under Fed. R. Civ. P. 12(b)(1) and (6). Although Judge Dominguez Braswell permitted the filing of the Supplemental Motion to Dismiss, the Court prefers one motion to dismiss which includes all Rule 12 arguments, as provided in WJM Revised Practice Standard III.D.2 (“All requests for relief under any part of Rule 12 must be brought in a single motion.”) Therefore, the Court STRIKES the motion to dismiss briefing filed thusfar, 26, 41 . Defendants may file a single motion to dismiss of no more than 25 pages directed at the operative 30 Second Amended Complaint by November 11, 2022. Plaintiff may file a response of no more than 25 pages by November 30, 2022. Defendants may file a reply of no more than 15 pages by December 12, 2022.
