This case is about a protection and advocacy (P&A) agency’s representation of a student plaintiff who was seeking to enforce a mediation agreement between the student's parents and the school district. The mediation agreement included terms about the location of special education services, transportation to the school, a bus aide and paraprofessional, direct instruction for specialized services, consultation with former teachers, holding an individualized education plan meeting, and conducting a functional behavioral assessment.  The student alleged the school failed to substantially comply with those terms.  On October 5, 2021, Disability Rights Florida (DRF) filed this lawsuit in the U.S. District Court for the Middle District of Florida on behalf of the student and asserted violations of state contract law and the Individuals with Disabilities Education Act (IDEA). Judge Marcia Morales Howard presided.  The lawsuit sought a preliminary and permanent injunction requiring the District to fulfill its obligations under the mediation agreement; Equitable relief, such as compensatory-education services, to remedy the ongoing harm suffered, Declaratory relief; and reasonable attorney fees.

 On October 13, 2021, plaintiff filed an emergency motion for a preliminary injunction to "immediately providing her a placement in a self contained classroom, small group direct instruction in all academic areas by certified general-education and special-education teachers, paraprofessional support, counseling services, transportation to and from school on a special-education bus, and a bus aide."

On December 6, 2021, the parties entered into a consent decree where the school district would provide educational services to plaintiff each day. On December 20, 2021, the plaintiff moved for attorneys’ fees and expenses which was granted in part and denied in part on August 1, 2022. The case is now closed.
